RECOMMENDATION:
It is recommended that the Board of Supervisors:
a Approve an amendment to the Agreement with the Historical Society for the Care, Custody and Control of Certain Records (Original Agreement) that reflects the actual records in their care;
b. Remove records from the Monterey County Superior Court of California from the terms and conditions of the Original Agreement; and
c. Authorize the Chair of the Board to sign the amendment.
SUMMARY/DISCUSSION
On June 21, 1983, the County and the Historical Society entered into an agreement for the care, custody and control of certain records (the Original Agreement). Some of the records transferred to the Historical Society belong to the Superior Court of California, County of Monterey (Court) and properly belong to the Court. Some of the records listed in the original records inventory were never transferred to the Historical Society. Some of the records on the original records inventory were mislabeled.
The Historical Society has completed a new inventory of all County records in their care (see attached) and now would like to amend the original contract to reflect the actual records within their care and to remove the records that belong to the Court from the terms and conditions of the Original Agreement.
OTHER AGENCY INVOLVEMENT:
The Monterey County Superior Court, the Monterey County Historical Society and County Counsel concur with this recommendation
FINANCING:
There is no impact to the General Fund Contribution arising from this transaction.
