b. Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 9 to Professional Services Agreement No. A-11286 and future amendments that do not significantly alter the scope of work or change the approved Agreement amount.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 9 to Professional Services Agreement No. A-11286 with Wood Rodgers, Inc. to provide additional tasks associated with acquiring regulatory permits, and preparation of the Project Study Report/Project Report for the Monterey Bay Sanctuary Scenic Trail - Moss Landing Segment, County Project No. 8668, to increase the not to exceed amount by $110,120 for a total amount not to exceed $2,307,188, with no extension to the term of the Agreement from October 1, 2008 to June 30, 2022; and
b. Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 9 to Professional Services Agreement No. A-11286 and future amendments that do not significantly alter the scope of work or change the approved Agreement amount.
SUMMARY:
Approval of Amendment No. 9 to Professional Services Agreement (PSA) No. A-11286 with Wood Rodgers, Inc. (WRI) to provide professional services for the Monterey Bay Sanctuary Scenic Trail (MBSST) (Project) will allow the Resource Management Agency (RMA) to continue to retain WRI to perform additional tasks associated with preparation of regulatory permits and preparation of the Project Study Report/Project Report as required by the California State Department of Transportation (Caltrans). Other remaining tasks include project management; preparation of Final Plans, Specifications and Engineer’s Estimate (PS&E); assistance during bidding and construction; and additional services associated with the Project as requested by County.
DISCUSSION:
The MBSST Project is a segment of the MBSST Master Plan, dated July 2007. The Master Plan was developed by the Transportation Agency for Monterey County (TAMC) in collaboration with Public agencies, nonprofit organizations and the Public to construct a trail to allow people to bicycle around Monterey Bay from Lovers Point in Pacific Grove to Wilder Ranch in Santa Cruz. The primary purpose of the trail is to enhance appreciation and protection of the Monterey Bay National Marine Sanctuary by promoting Public use and enjoyment at its shoreline. Since the Moss Landing segment is under the jurisdiction of the County of Monterey (County), the County is the Project sponsor responsible for designing, constructing, and managing the segment.
The Project proposes to construct a bicycle/pedestrian path along State Route 1, from Moss Landing Road to the north side of Elkhorn Slough, near the community of Moss Landing. The path is approximately 0.86 of a mile long and includes constructing a twelve foot (12’) wide bridge, approximately 386 feet (386’) long over Elkhorn Slough.
The Project has been on hold due to the lack of funds for the Construction Phase of the Project. Prior to this, RMA staff progressed through the Environmental Phase of the Project with adoption of a Mitigated Negative Declaration and the Mitigation and Monitoring Reporting Program in September 2015. Design is ninety (90%) complete; and with the programmed Active Transportation Program (ATP) construction funds, through Senate Bill 1 (SB 1), staff has moved forward with the permitting and right-of-way phase of the project. It is anticipated that the design phase will be completed by December 2019.
In cooperation with Caltrans and TAMC, staff is striving to acquire the necessary numerous regulatory permits. Due to the extensive coordination with the various regulatory agencies and preparation of permit documents, additional funds are needed to complete this phase of the project.
Amendment No. 9 will allow WRI to continue with the permitting phase of the project and complete their remaining tasks for project completion. The amendment to WRI’s PSA will increase the not to exceed amount of $2,197,068 by $110,120 for a total amount not to exceed $2,307,188, with no extension to the term of the Agreement from October 1, 2008 to June 30, 2022.
Amendment No. 9 is to be fully funded with Measure X with sufficient appropriations in FY 2019-20 in Fund 002, Appropriation Unit RMA012. To date $396,563 in County’s own share of Measure X have been budgeted for the project. Given that this is a regional project that involves construction of a new facility adjacent to State Route 1, staff is in discussion with TAMC proactively seeking regional funds such as regional Measure X and/or Regional Surface Transportation Program (RSTP) for the project.

OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel-Risk Management and Auditor-Controller’s Office have reviewed and approved Amendment No. 9 as to form and legality, and fiscal provisions, respectively.
FINANCING:
The total estimated Project cost, including engineering design, environmental, right-of-way, utilities and construction is $13,784,436. Expenditures incurred for this Agreement from Fiscal Year (FY) 2007-08 through FY 2018-19 total $2,072,586. With the approval of Amendment No. 9, the remaining balance for this Agreement is $234,602 and is expected to be expended over the next three (3) FYs.
The Project is funded by various Federal, State and grant funding sources: Safe, Accountable, Flexible, Efficient and Transportation Equity: A Legacy for Users (SAFETEA-LU), gas tax; Measure X; 2% Transportation Development Act (TDA), Active Transportation Program (ATP); and a Coastal Conservancy Grant.
Amendment No. 9 will be funded with Measure X and sufficient appropriations are available in the FY 2019-20 Road Fund 002, Appropriation Unit RMA012 budget.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
Amendment No. 9 will allow for additional tasks to complete the Project to construct a sustainable, physical infrastructure that improves the quality of life for County residents. The recommended action supports the following Board of Supervisors’ Strategic Initiatives as indicated below:
