RECOMMENDATION:

It is recommended that the Board of Supervisors introduce, waive reading, and adopt an urgency ordinance to prohibit overnight parking from 10:00 pm to 6:00 am on Potrero Road: on the south side, from State Route 1, westerly to the terminus of Potrero Road at the north side of the Salinas River State Beach parking lot; and on the north side, from the centerline of Laguna Place westerly to the terminus of Potrero Road at north side of the Salinas River State Beach parking lot, in the unincorporated area of Monterey County. (4/5ths    vote required).

 

SUMMARY/DISCUSSION:

On August 16, 2021, Monterey County Public Works, Parks and Facilities (PWFP) staff participated in a Virtual Moss Landing Community Meeting.  At this meeting, residents voiced their concerns associated with overnight vehicles parking along Potrero Road.  Residents feel the absence of signs prohibiting overnight parking encourages visitors to park in the neighborhood for extended periods. 

 

In response to the community concerns, Board Referral No. 2021.22 was prepared requesting to codify ‘No Overnight Parking’ on Potrero Road in Moss Landing, and assigned to Public Works, Parks and Facilities at the October 26, 2021 Board meeting.  Illegal roadside camping on Potrero Road has created public health and safety concerns for the community of Moss Landing, particularly regarding fire safety and dumping of waste, including human waste.  The intent of applying and enforcing the ordinance is to install the requisite signage, and clarify and strengthen the ability for peace officers to enforce and better implement the intent of Monterey County Code Section (MCC) 12.28.021 (No Overnight Parking).  Codification of ‘No Overnight Parking’ on Potrero Road would allow the installation of appropriate signage to alert motorists of the parking restrictions, and enable law enforcement to cite violators and enforce ‘No Overnight Parking.’ 

 

On November 16, 2021, Monterey County Public Works, Parks and Facilities (PWFP) provided the Board a preliminary analysis report in response to said Board Referral  At the community meeting, PWFP discussed applying MCC 12.28.021 prohibiting parking from 10:00 pm to 6:00 am on the south side of Potrero Road beginning from the centerline of State Route 1 (SR 1) to the centerline of Laguna Place, and on both sides thereafter to the terminus of Potrero Road at the north side of the Salinas River State Beach parking lot.  Currently parking is prohibited at all times on the south side of Potrero Road from Bridge C167 easterly to SR 1 (MCC 12.28.010).  Applying the overnight parking prohibition would require converting the ‘no parking at all times’ to ‘no overnight parking,’ thereby establishing a consistent, continuous prohibition of parking vehicles overnight along the entire length of Potrero Road, except for the portion on the north side of Potrero Road between SR 1 and Laguna Place along the frontage of the homes to still allow overnight parking for residents.  Additionally, since the Salinas River State Beach hours are from 8:00 am to sunset, and proposed parking prohibition would be consistent with the times the beach is available to the public.  Feedback from the public was positive, and the community was in support of the parking prohibition as proposed.

 

An urgency ordinance is proposed in order to take effect immediately; staff will process a due -course ordinance to amend the County Code in the future as appropriate.

 

CEQA

The adoption of these ordinances is categorically exempt under the California Environmental Quality Act (CEQA) pursuant to section 15301 (c) of the CEQA Guidelines because the action involves negligible changes to the regulations that govern the existing highways and streets.

 

OTHER AGENCY INVOLVEMENT:

Monterey County requires an amendment to the ordinance in order for the Potrero Road parking prohibition to be enforceable.  The California Highway Patrol (CHP) currently has authority to provide enforcement and issue citations related to operation of motor vehicles on County roads. 

 

FINANCING:

Adoption of this ordinance requires the posting of appropriate signage. These traffic control devices will be funded by the Road Fund. The estimated cost for the installation of new no parking signs is $15,000. Funds are available in the FY 2021-22 Adopted Budget for the Road Fund 002, Unit 8559, Appropriation Unit PFP004 to finance this work.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The recommended action supports the Board of Supervisors’ Strategic Initiative for Infrastructure and Public Safety, Meeting our Facilities, Water, Technology and Transportation Needs. The ordinances will allow for the permanent No Parking at Any Time designation that will improve the quality of life for County residents and support economic development results.
