RECOMMENDATION:
It is recommended that the Board of Supervisors:
As code reviewing body, adopt a Resolution approving the proposed amendment of the Conflict of Interest Code of the Health Department of Monterey County.

SUMMARY/DISCUSSION:
The Political Reform Act of 1974 (Government Code sections 810000, et. Seq.), requires state and local government agencies to adopt Conflict of Interest Codes and to periodically review and make necessary changes to their codes. Amendments to the Health Department's Conflict of Interest Code are authorized by section 87306 of the Government Code, whenever changes are required by changed circumstances, by creation or deletion of designation positions, or by changes in the duties of designated positions. Numerous position and title changes have occurred at the Health Department since 2014, when its Conflict of Interest Code was last amended. Thus, there is need to amend its code to accurately reflect the current designated positions and titles.

Pursuant to sections 82011 and 87303 of the Government Code, the Board of Supervisors is the code reviewing body. It may approve the Code as submitted; revise the proposed code and approve it as revised; or return the proposed Code to the agency for revision and resubmission. The proposed, amended Code is attached for review and approval.

OTHER AGENCY INVOLVEMENT:
County Counsel has reviewed finds that the proposed Code, as submitted, is lawful under the Political Reform Act of 1974.

FINANCING:
There is no financial impact upon the County of Monterey resulting from the Board's approval of the proposed amendment to the Department of Health's Conflict of Interest Code.
