RECOMMENDATION:
It is recommended that the Monterey County Water Resources Agency Board of Directors:

a. Authorize the General Manager to amend up to two separate consultant contracts, each of which the contract amount is over $100,000, for a total amended amount not to exceed $200,000 for work related to Department of Water Resources Division of Safety of Dams and the Federal Energy Regulatory Commission Division of Dam Safety requirements for Nacimiento and San Antonio Dams and Reservoirs for this winter; and
b. Authorize the General Manager to execute those contract amendments.

SUMMARY/DISCUSSION:
Both the State of California Department of Water Resources Division of Safety of Dams and the Federal Energy Regulatory Commission Division of Dam Safety has given the Monterey County Water Resources Agency a deadline of December 31, 2018, to complete a series of activities at both Nacimiento and San Antonio Dams. In order to address this immediate need, staff is being reassigned tasks and has engaged the FERC Part 12D consultant to assist on specific items. This work is outside their current scope and will be addressed in the contract amendment.

The DSOD and FERC has the authority to penalize the MCWRA by limiting reservoir storage.

Additionally, the FERC has the authority to penalize the MCWRA by charging a penalty of $22,000 per day and revoking the Power Production License.
