b. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Adopt an ordinance amending Section 12.28.010 of the Monterey County Code to prohibit parking at all times on the east side of State Highway 1 from the centerline of the Point Lobos State Park entrance northerly for a distance of 1800 feet and from the centerline of the Point Lobos State Park entrance southerly for a distance of 1800 feet, in the unincorporated area of Monterey County (Attachment A);

b.                     Adopt an ordinance amending sections 12.28.010 and 12.28.021 of the Monterey County Code to change the parking restriction on both sides of Rio Road from Carmel Rancho Boulevard easterly to its terminus in the unincorporated area of Monterey County, from no parking between 10:00 p.m. and 6:00 a.m. to no parking at any time (Attachment B); and

c.                     Authorize the Director of Resource Management Agency to apply on behalf of the County for an encroachment permit from Caltrans to install no parking signs on the east side of State Highway 1 adjacent to Point Lobos State Park in accordance with the adopted ordinance.

 

SUMMARY/DISCUSSION:

On December 11, 2018, the Board introduced, waived the reading, and set January 15, 2019, to consider: adoption of an ordinance amending Section 12.28.010 of the Monterey County Code to prohibit parking at all times on the east side of State Highway 1 from the centerline of the Point Lobos State Park entrance northerly for a distance of 1800 feet and from the centerline of the Point Lobos State Park entrance southerly for a distance of 1800 feet, in the unincorporated area of Monterey County; and adoption of an ordinance amending the sections 12.28.010 and 12.28.021 of the Monterey County Code to change the parking restriction on both sides of Rio Road from Carmel Rancho Boulevard easterly to its terminus in the unincorporated area of Monterey County, from no parking between 10:00 p.m. and 6:00 a.m. to no parking at any time.

 

The County Resource Management Agency (RMA) and District 5 Board Office received multiple requests from local residents advocating the establishment of no parking at any time on the east side of State Highway 1, from a point 1800 feet north of the Point Lobos State Park entrance to a point 1800 feet south of the Point Lobos State Park entrance, a distance of 3600 feet. State park patrons often park along State Highway 1 and cross the highway to access the park creating unsafe conditions for drivers.  This prohibited parking along State Highway 1 potentially stops unsafe pedestrian movement on the state highway at this location.   The ordinance to prohibit parking on a state highway requires approval of the state Department of Transportation (Caltrans).  Accordingly, the ordinance is written so that  this restriction will not become operative unless and until approved by the State Department of Transportation, and staff is seeking authorization to apply for an encroachment permit from Caltrans If the ordinance is adopted and Caltrans issues the encroachment permit, the permanent “No Parking at Any Time” signs will be placed on the east side of State Highway 1, 100 feet apart from a point 1800 feet north of the Point Lobos State Park entrance to a point 1800 feet south of the Point Lobos State Park entrance.   

 

RMA has also received multiple requests from local residents advocating the establishment of  “No Parking at Any Time” on both sides of Rio Road, from the centerline of Carmel Rancho Boulevard easterly to Rio Road’s terminus because of vehicles that park during daylight hours blocking the sight distance of driveways that cause unsafe turning movements, and to prevent the dumping of garbage from trucks that park during the day in this area. Currently, the area is signed for “No Parking from 10:00 p.m. to 6:00 a.m.”, pursuant to Monterey County Code section 12.28.021 (Ord. 4166). The proposed ordinance would convert the restriction to no parking at any time, by removing this road from Monterey County Code section 12.28.021 and adding this section of road to section 12.28.010. No Parking at Any Time signs will replace the time limited signs of No Parking from 10:00 p.m. to 6:00 a.m. on both sides of Rio Road from Carmel Rancho Boulevard easterly to its terminus. The sign locations are shown in Attachment C.

 

CEQA

The adoption of these ordinances is categorically exempt under the California Environmental Quality Act (CEQA) pursuant to section 15301 (c) of the CEQA Guidelines because the action involves negligible changes to the regulations that govern the existing highways and streets.

 

OTHER AGENCY INVOLVEMENT:

Caltrans must issue an encroachment permit in order for the State Highway 1 parking prohibition to go into effect. RMA is working with Caltrans to coordinate efforts to expedite the encroachment permit for State Highway 1.  County Counsel has approved the ordinances as to legal form.

 

FINANCING:

Traffic control devices are funded by the Road Fund.  The cost to install the necessary signing is estimated at $800.00.  Sufficient funds are available in the FY 2018-19 Adopted Budget for the Road Fund 002, Unit 8195, Appropriation Unit RMA0012 to finance this work.

 

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The recommended action supports the Board of Supervisors’ Strategic Initiative for Infrastructure and Public Safety, Meeting our Facilities, Water, Technology and Transportation Needs. The ordinances will allow for the installation of No Parking at Any Time signs that will improve the quality of life for County residents and support economic development results.
