RECOMMENDATION:
It is recommended that the Board of Supervisors:
Approve and authorize the Chair of the Board of Supervisors to execute a Modification of the agreement entitled "Memorandum of Agreement among the Fort Ord Reuse Authority, Monterey County and Cities of Seaside, Monterey, Del Rey Oaks and Marina, California State University Monterey Bay, University of California Santa Cruz, Monterey Peninsula College, and the Department of Toxic Substances Control Concerning Monitoring and Reporting on Environmental Restrictions on the former Fort Ord, Monterey County, California."

SUMMARY:
With the dissolution of the Fort Ord Reuse Authority (FORA) on June 30, 2020, the County will assume FORA's obligation to compile and file an annual report with the Department of Toxic Substances Control ("Department" or "DTSC") regarding jurisdictions' compliance with land use controls on former Fort Ord properties. This obligation is pursuant to a 2008 Memorandum of Agreement among FORA, the County the Cities of Seaside, Monterey, Del Rey Oaks, and Marina , California State University Monterey Bay ("CSUMB"), University of California Santa Cruz ("UCSC"), and Monterey Peninsula College ("MPC") .
