RECOMMENDATION:
It is recommended that the Board of Supervisors approve and authorize the County Purchasing Agent or designee to execute a retroactive non-standard Agreement with Krazan & Associates, Inc., for environmental and geotechnical testing for the solar projects at 168 W. Alisal and 1490 Moffett St, effective May 1, 2026 through December 31, 2026, total amount not to exceed $6,189.

Staff recommends that the Board of Supervisors approve this retroactive agreement for Krazan & Associates to perform necessary environmental and geotechnical testing for the solar projects at 168 W. Alisal and 1490 Moffett St.

DISCUSSION:
This additional environmental testing is required because of adverse conditions at 168 W. Alisal involving soil conditions and underground water flows. The original subcontractor for environmental testing through Opterra Inc., the primary solar general contractor, was unable to perform this additional level of testing to verify that proposed mitigations made by the solar project team would be sufficient. Krazan was selected to perform this work, and the scope was authorized due to the necessity of meeting the Net Energy Metering 2.0 deadline in April of 2026 and relatively low cost of the environmental testing, which is why this agreement requires retroactive approval. This deadline was met and provides the County with significant cost savings for the next 30 years of system operation.

OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS:
The Office of the County Counsel has reviewed and approved the proposed retroactive agreement as to form.

FINANCING:
The related cost will be absorbed by Sol...
