Title: a. RECOMMENDATIONS:

It is recommended that the Board of Supervisors:

a.                     execute a non-standard Agreement with Project Leadership Associates (PLA), a Microsoft solutions partner, to implement the Microsoft Enterprise Management (EMS) Suite for the period of November 2, 2015 through January 15, 2016, paid for by Microsoft Inc., at no cost to the County of Monterey;  

b.                     Accept non-standard contract provisions as recommended by the Director of the Information Technology Department;

c.                     Authorize the Director of Information Technology, upon satisfactory completion of implementation services, to complete and provide a proof of execution notice to Microsoft certifying completion of all work at the end of the engagement.

 

SUMMARY

It is requested that the Board of Supervisors authorize the Contracts/Purchasing Officer to sign a non-standard Agreement with Project Leadership Associates (PLA), a Microsoft Corporation (Microsoft) solutions partner, for the provision of implementation services of the Microsoft Enterprise Management (EMS) Suite over the period of November 2, 2015 through January 15, 2016 at no cost to the County. It is also requested that the Board authorize the Director of the Information Technology Department to complete and provide a proof of execution notice to Microsoft certifying completion of all work at the end of the engagement.

 

DISCUSSION:

In March 2015, the Board authorized the execution of a State and Local Agency Enterprise Enrollment Volume Licensing Agreement with PCM-G, a Microsoft licensing reseller, for the provision of the Microsoft Enterprise Management (EMS) Suite. The County’s technology infrastructure has been upgraded using licenses bundled in the EMS Suite; thus, the County is positioned to fully deploy the remainder of the components of the EMS suite. As a part of the EMS procurement, Microsoft made funding available to PLA to assist the County in configuring EMS suite components to enable the County to fully utilize the various portions of the product including:  Azure Active Directory Premium,  Self Service Password Reset, Azure Multi-Factor Authentication, and Intune Remote Device Management services.

 

Under the terms of the proposed Agreement, the County will review the work provided by PLA to ensure that all components listed in the statement of work are completed to the County’s standards.  It will then provide a certification of execution to Microsoft, authorizing Microsoft to pay PLA directly for the delivery of the services to the County provided for by this Agreement.

 

OTHER AGENCY INVOLVEMENT:

County Counsel and Risk have reviewed and do not approve the following non-standard terms:  restrictions on the County’s ability to terminate the contract; provisions requiring the County to indemnify the PLA; limitations on the damages available to the County to $10,000; shortened statute of limitations periods during which to bring claims; non-solicitation obligations imposed upon County; and limitations on PLA warranty obligations.

 

FINANCING:

 

The funds to be paid to PLA will be paid in entirety by Microsoft. As such, there will be no budgeted monies expended and no impact on the General Fund.
