Adopt a Resolution to:
a. Authorize the Resource Management Agency to submit five (5) grant applications totaling $21,783,319 to the Federal Highway Administration, Office of Federal Lands Highway (FLH) for Federal Lands Access Program funds as part of the 2017 Call For Projects; and
b. Authorize the Resource Management Agency Director, or the RMA Interim Deputy Director of Public Works and Facilities to certify that the County will provide maintenance for each project facility for the life of the facility or 20 years, whichever is greater; and
c. Authorize the Resource Management Agency Director, or the RMA Interim Deputy Director of Public Works and Facilities to enter into Reimbursable Agreements (RA) for $10,000 per project with the Federal Highway Administration, Office of Federal Lands Highway (FLH), up to five (5) projects ($50,000); and
d. Authorize the Resource Management Agency Director, or the RMA Deputy Director of Public Works and Facilities to act as the agent for the County to accept, administer and execute documents to secure any resulting award from the FLH, execute amendments to any resulting award agreements and to sign and execute invoices on behalf of the County of Monterey.

RECOMMENDATION:
It is recommended that the Board of Supervisors adopt a Resolution to:
a. Authorize the Resource Management Agency to submit five (5) grant applications totaling $21,783,319 to the Federal Highway Administration, Office of Federal Lands Highway (FLH) for Federal Lands Access Program funds as part of the 2017 Call For Projects; and
b. Authorize the Resource Management Agency Director, or the RMA Interim Deputy Director of Public Works and Facilities to certify that the County will provide maintenance for each project facility for the life of the facility or 20 years, whichever is greater; and

SUMMARY:
The Resource Management Agency plans to submit five (5) applications to the Federal Highway Administration (FHWA), Office of Federal Lands Highway (FLH), to the Federal Lands Access Program grant totaling $21,783,319 by May 12, 2017. These applications request funding for repairs to Palo Colorado Road, Carmel Valley Road, Tassajara Road, Coast Road, and Los Burros Road, improving road conditions and safety, and preventing increased maintenance costs for this County. FLH is expected to announce awards for this grant program in September 2017.
The project is expected to take place between July 2021 and June 2022, and will be administered by the Resource Management Agency with assistance from the FHWA.
DISCUSSION:
Between July and September 2016, the Soberanes Fire burned over 132,000 acres in Monterey County. Heavy fire and emergency vehicles damaged numerous County roads which provide access to residents and the Los Padres National Forest. This disaster was followed by the 2016-17 winter storms which exacerbated County roadway damage caused during the 2016 Soberanes Fire, severely damaging several County roadways, resulting in temporary closures and emergency repairs.
The FLAP grant application requires the County to certify that it will provide maintenance for any awarded road project. These roads are included in the County’s current road maintained mileage and will continue to be monitored for needed repairs and maintenance. Roads will be maintained in accordance with the Annual Road Maintenance Plan and the Pavement Asset Management Plan. This certification does not require that project roads override priority for other County roads. It only certifies that the County will provide a level of service comparable to other similar roads and that roads will not be abandoned. If awarded, this project will implement long-term repairs to portions of one (1) or more of these roadways, preserving access for County residents, improving roadway safety, reducing County maintenance costs, and making facilities more resistant to future storm damage. If funded, the project is expected to take place between July 2021 and June 2022.
If a project application is awarded, the County will be expected to enter into a maximum $10,000 Reimbursable Agreement (RA) for each application (up to $50,000) within 45 days of award for the completion of project scoping by Central Federal Lands that will result in more accurate project scope, schedule and budget. A final project selection is scheduled for late 2018. If a project is included in the final selection, the RA will be amended for the entire match amount. The full matching funds are not needed until that time. The $10,000 already committed to project scoping will be counted as a credit towards the required matching funds amount.
OTHER AGENCY INVOLVEMENT:
This application was facilitated by the County Administrative Office - Intergovernmental and Legislative Affairs, under the Strategic Grant Services Program. Support for this application was provided by the United States Forest Service, Los Padres National Forest and Monterey Ranger District.
FINANCING:
The County is required to provide an 11.47% match to any grant awarded under FLAP. Funding requirements for the five (5) projects are as follows:
Palo Colorado Road: Project Total: $8,894,600, $1,020,211 match
Carmel Valley Road: Project Total: $7,720,240, $885,512 match
Tassajara Road: Project Total: $3,474,900, $398,571 match
Coast Road: Project Total: $1,155,035, $132,482 match
Los Burros Road: Project Total: $538,544, $61,771 match
The total funding requirement for all five (5) projects is $21,783,319 with a total $2,498,547 matching funds required. Matching funds for any awarded applications will be required in FY 2021/22. RMA has identified two (2) potential financing sources within the Road Fund that if available may be used as matching funds for each of the applications. These financing sources would be the County’s Transient Occupancy Tax (TOT) Road Fund allocation and the Transportation of Monterey County’s sales tax initiative also referred to as Measure X.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
These grant applications support the Infrastructure, Economic Development, and Public Safety Policy Areas of the Board’s Strategic Initiatives by seeking funding for long-term repairs of rural roadways which provide access to residents and provide access to tourists visiting Los Padres National Forest. This supports sustainable, physical infrastructure that improves the quality of life for County residents and supports economic development.
