Title: a. b.  Ratify the actions of the County Administrative Officer and Authorize the County Administrative Officer to execute any and all documents needed to complete a transfer of the trailers to the City of King, including but not limited to Release of Title, notices or related documents. 

 

Report

RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.  Retroactively declare that four (4) County owned recreational vehicle trailers located at 1160 Broadway, King City, California  (San Lorenzo Park) are no longer needed for public purposes by the County of Monterey; and

b.  Ratify the actions of the County Administrative Officer and Authorize the County Administrative Officer to execute any and all documents needed to complete a transfer of the trailers to the City of King, including but not limited to Release of Title, notices or related documents.

 

SUMMARY/ DISCUSSION:

The County of Monterey (“County”) owns (4) recreational vehicle trailers (“RV Trailers”), more particularly described in Exhibit “A” of the attached Transfer Agreement.  The RV Trailers were four (4) of twenty (20) trailers located at 1160 Broadway in King City (“San Lorenzo Park”) used by the County’s Emergency Operations Center, Operations Section, Care and Shelter Branch to house individuals needing to be quarantined during the COVID-19 pandemic.

 

The City of King (“City”) was in emergency need of the RV Trailers to use as temporary housing for individuals and families experiencing homelessness in the local community. Pursuant to the Monterey County Code 2.32.030(E), the County Administrative Officer ("CAO"), as the County’s Purchasing Agent, has the authority to transfer personal property not needed for COUNTY’s purposes from the County to another public agency.

 

The RV Trailers were transferred to the City, at no cost and in“as is” condition via the attached Transfer Agreement, which was effective on June 6, 2022. The City waived any claim related to the condition of the RV Trailers other than any warranty provided by RV Trailer manufacturer (if any) and shall be responsible all related insurances.

 

While the CAO has the authority to cause the transfer of the RV Trailers, the Board must take action to declare that the RV Trailers are no longer needed for public purposes by the County, and may do so retroactively.    In the event Board does not take such action, the Transfer Agreement shall terminate, and ownership of the RV Trailers shall revert to the County.

 

OTHER AGENCY INVOLVEMENT:

Public Works, Pacilities and Parks Department assisted with the development of the Transfer Agreement and Board Report.   The Office of the County Counsel has reviewed and approved the proposed Transfer Agreement as to form and legality.  Risk Management has reviewed the proposed Transfer Agreement as to indemnity provisions. The City of King supports the proposed Transfer Agreement. 

 

FINANCING:

There is no financial impact to the General Fund.  All costs associated with the removal of the four (4) recreational vehicles will be at the expense of the City of King.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

This action correlates to the Health and Human Services initiative adopted by the Board of Supervisors by helping address homelessness in Southern Monterey County.
