RECOMMENDATION:
It is recommended that the Board of Supervisors:

SUMMARY/DISCUSSION:
The Board of Supervisors approved the County's agreements with UCMB and CIMH in 2009 for providing funding of an MSW program at CSUMB.  The purposes and interrelationship of these two agreements, as originally approved, are described in Attachment A.
The Mental Health Services Act/Prop 63 (MHSA) Southern Bay Area Regional Partnership ("SBARP"), the workforce development initiative established to develop a local public mental health workforce in Monterey, San Benito, and Santa Cruz counties, recently agreed to provide additional funding for the MSW program at CSUMB to, among other things, increase funding for the MSW scholarship fund and to pay for administrative costs associated with the MSW program at CSUMB.  Accordingly, the parties seek to amend the UCMB and CIMH agreements.
 
The scholarship fund for MSW students offsets their educational costs, retains current students, and attracts potential applicants to the MSW program. The one-time scholarships of $5,000 each are administered by CSUMB's Financial Aid Office and are awarded based on the following desirable criteria: students are bilingual/bicultural; in their 2nd/3rd year of the MSW program; in a mental health (children's/adults) concentration; and are from the tri-county area, Monterey, Santa Cruz or San Benito counties upon application to the MSW program.  Eligible students also meet merit and need criteria.  The MSW scholarship fund aims to address the alarming trends of increased financial burdens on current MSW students and limited access to higher education for potential students.  Amendment No. 3 to Agreement No. A-11518 with UCMB extends the term by two fiscal years to June 30, 2015 and adds $120,000 to provide additional funding for the MSW scholarship fund and for additional operational support of the MSW program at CSUMB, for a revised total Agreement amount not to exceed $550,000.
 
Amendment No. 1 and Renewal of Consulting Agreement No. A-12221 with CIMH extends the term by three fiscal years to June 30, 2015 and adds $360,000, for a revised total Agreement amount not to exceed $480,000.  The Agreement will fund the contract between the County and the UCMB for the MSW program at CSUMB in the amount of $120,000 and will fund educational and training activities for the SBARP in the amount of $240,000.
 
This Agreement contains the County's standard 30-day "no cause" provision (Section IV, B) and an additional defunding provision (Section IV, D), which provides the County the ability to amend or terminate the Agreement in the event of a reduction and/or termination of funding.  
 
OTHER AGENCY INVOLVEMENT:
County Counsel and Auditor-Controller have reviewed and approved this Amendment No. 3 with UCMB and Amendment No. 1 and Renewal with CIMH as to legal form, legality and fiscal provisions.  Risk Management has reviewed and approved the Amendments previously listed as to insurance requirements and has agreed to a modification to the indemnification clause, which is a deviation from the County's standard indemnity contract language.  Amendment No. 3 to Agreement A-11518 is on file with Clerk of the Board, and Amendment No. 1 to Agreement A-12221 is on file with Clerk of the Board.
 
FINANCING:
CIMH is subcontracting with Monterey County because Monterey County is the fiscal agent for the SBARP.  These Agreements will allow the pass through of the State Department of Mental Health funding from CIMH through the SBARP to the MSW program at CSUMB.
 
These Amendments are funded by the Mental Health Services Act. The funds for Amendment No. 3 with UCMB ($120,000) and Amendment No. 1 and Renewal with CIMH ($360,000) are included in the Health Department's Behavioral Health (HEA012, Unit 8410) Fiscal Year 2012-13 Adopted Budget. Approval of this action has no impact on the County General Fund.
