RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.  Approve Amendment No. 1 to Professional Services Agreement No. A-14989, Multi-Year Agreement #3200*5395, with MNS Engineers, Inc. to provide construction management services for the Nacimiento Lake Drive Bridge Replacement Project, County Bridge No. 449, Request for Proposals #10757, to extend the expiration date for 1 additional year through October 13, 2024, for a revised term of October 13, 2020 to October 13, 2024, with the option to extend the term for 1 additional 1-year period, and increase the not to exceed maximum by $244,184 to a total amount of $1,478,243; and

SUMMARY/DISCUSSION:

The recommended actions would allow for the approval of Amendment No. 1 (Attachment A) to Professional Services Agreement (PSA) No. A-14989 with MNS Engineers, Inc. (MNS) to: update the provisions of the PSA, extend the expiration date for 1 additional year through October 13, 2024, for a revised term of October 13, 2020 to October 13, 2024, with the option to extend the term for an additional 1-year period, and increase the not to exceed maximum by $244,184 to a total of $1,478,243, to allow for continued construction management services for the Nacimiento Lake Drive Bridge Replacement Project, County Bridge No. 449 (Project).

 

 

 

 

The County of Monterey, Department of Public Works, Facilities and Parks (PWFP) proposes to construct a new bridge on Nacimiento Lake Drive over the San Antonio River.  The existing bridge is one-lane and was determined to be seismically deficient and is programmed to be replaced under the State Seismic Retrofit Program.          

 

MNS was selected for their expertise and capabilities necessary to provide construction management services for the Project under a competitive selection process in accordance with County policies and State and Federal laws under Request for Proposals (RFP) #10757.  On October 13, 2020, the Board of Supervisors approved PSA No. A-14989 with MNS in the amount of $1,234,059 to provide construction management services for the Project for a term through October 13, 2023.

 

A colony of State threatened tricolored blackbirds nesting at the project site limited the seasonal window of time to complete construction activities and a second season of construction was necessary to complete the new bridge construction.  The new bridge has been completed and was opened to traffic earlier in the year.

 

The removal of the existing bridge was set back from the end of July 2022 out to October 2023 due to utility relocation delays for the Project and work windows which delayed the bridge removal timeline.  Additional time and funding will allow for Project closeout and plant establishment for completion of the Project.

 

PWFP staff recommends that the County of Monterey Board of Supervisors approve the proposed Amendment No. 1 (Attachment A) to the PSA with MNS to continue to allow construction management services for the Project.  Amendment No. 1 will update the provisions of the PSA, extend the expiration date for an additional year through October 13, 2024, for a revised term of October 13, 2020 to October 13, 2024, with the option to extend the term for 1 additional 1-year period, and increase the not to exceed maximum by $244,184 to a total amount of $1,478,243.

 

Attachments B, C, D and E, provided for reference, include PSA No. A-14989, Project budget, Project location map and a summary of the PSA and its annual expenditures and balance to date.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel and the Auditor-Controller’s Office have reviewed and approved Amendment No. 1 as to form, and fiscal provisions, respectively. 

 

FINANCING:

The total estimated cost of the Project, including design engineering, environmental, right-of-way, utilities and construction is $11,104,830.  The original Project budget was $10,860,352.

 

The County has secured Federal Highway Administration (FHWA) funding for the identified Project as outlined in Attachment C, Project Budget.  The Project is largely funded (88.53%) by FHWA Highway Bridge Program (HBP) funds in the amount of $8,874,822, and State Seismic funds (11.47%) in the amount of $907,708.  The remaining $1,322,300 will be funded through Local funds such as Measure X and the Road Fund.  There are sufficient appropriations adopted in the Fiscal Year (FY) 2023-24 Road Fund 002, Appropriations Unit PFP004 Budget to finance Amendment No. 1.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The recommended action supports the Board of Supervisors’ Strategic Initiatives for Infrastructure and Public Safety.  The Project will replace the existing seismically deficient one-lane bridge with a new two-lane bridge that meets current Caltrans design standards.  Also, as part of the proposed Project, the bridge approaches will be reconstructed and thereby improve the pavement condition of this section of Nacimiento Lake Drive.
