RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Approve and authorize the Contracts/Purchasing Officer or their designee to execute a retroactive Agreement with Allied Universal Electronic Monitoring US, Inc. for electronic monitoring for Probation clients for a term retroactive to June 1, 2023 through December 31, 2023 for an amount not to exceed $105,000; and

b.                     Authorize the Contracts/Purchasing Officer or their designee to execute future amendments to the Agreement where the total amendments do not exceed 10% ($10,500) of the original Agreement amount and do not significantly change the scope of services, for a not to exceed maximum amount of $115,500.

 

SUMMARY/DISCUSSION:

Western States Contracting Alliance - National Association of State Procurement Officials (WSCA-NASPO) conducted a request for proposals process and awarded several vendor contracts for “Electronic Monitoring of Offenders” through a cooperative agreement, Master Agreement No. 00212 (Agreement). Through the Agreement managed by WSCA-NASPO and administered by the State of Washington, the County of Monterey Probation Department (Probation) became a participating agency of the Agreement with the vendor Allied Universal Electronic Monitoring US, Inc. (Allied Universal formerly 3M Electronic Monitoring, Inc. and Attenti US, Inc.) for electronic monitoring devices and services through a Participating Addendum that was executed on November 17, 2014.

 

Probation contracted Allied Universal to provide electronic monitoring services to Probation clients under the Electronic Monitoring Program as ordered by the Monterey Superior Court or as part of their probation supervision terms. The original term of the Agreement with Allied Universal was June 5, 2013 through December 31, 2016. The Agreement was subsequently amended a total of ten times for various reasons. Amendment No. 10 extended the term through May 31, 2023. Probation became aware that Master Agreement No. 00212 would no longer be extended and was advised that WSCA-NASPO was undergoing a new Request for Proposals (RFP) process to issue new contracts for electronic monitoring services. It was anticipated that the RFP would be completed in an expeditious manner and that new vendor contracts would be awarded before the expiration of the Agreement. This was not the case and participating agencies were advised in the middle of May 2023 to explore different options of extending the Agreement. After extensive research and consultation with WSCA-NASPO, County Contracts and Purchasing Division, and County Counsel, it was determined that the best and only option for Probation was to enter a County Standard Agreement with the contractor, Allied Universal, until a new WSCA-NASPO cooperative agreement is issued. Due to the time and effort that were necessary to research, negotiate, and develop the scope of the agreement, the County Standard Agreement with Allied is retroactive to a start date of June 1, 2023.

 

Probation is recommending the approval of the County Standard Agreement with Allied for a retroactive term of June 1, 2023 through December 31, 2023 for an amount not to exceed $105,000 in order to continue receiving the electronic monitoring services that are being provided by Allied Universal. These services are critical to the operations of Probation and are required for the supervision of Probation clients as mandated by the Monterey Superior Court or as part of the probation supervision terms for the various offender populations under probation.

 

OTHER AGENCY INVOLVEMENT:

The Agreement was approved by the Office of County Counsel as to legal form and by the Auditor-Controller as to fiscal terms. 

 

FINANCING:

The associated funding and appropriations of $105,000 are included in the Probation Department’s (PRO001 - Unit 8165) FY 23-24 Adopted Budget. There is no additional cost to the County General Fund with this recommendation.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

This recommendation supports the Board of Supervisor Strategic Initiatives of Public Safety by supporting Probation’s Electronic Monitoring Program. Probation utilizes electronic monitoring as a probation supervision tool for a number of different offender populations. Electronic monitoring serves as an intermediate sanction/detention alternative, as well as a tool to enhance public safety, by assisting officers in monitoring high risk populations in the community.
