Title

Approve and authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to:

a. Execute a non-standard Cross Connection Agreement between the County of San Luis Obispo and the County of Monterey for regulatory compliance services with a term of May 1, 2023 through June 30, 2025 for a not to exceed sum of $4,000 and;

b. Execute up to three (3) future amendments to the Cross Connection Agreement where the total amendments do not exceed 10%, or $400 of the agreement amount and do not significantly change the scope of work, subject to County Counsel approval.

RECOMMENDATION:

It is recommended that the Board of Supervisors approve and authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to:

a. Execute a non-standard Cross Connection Agreement between the County of San Luis Obispo and the County of Monterey for regulatory compliance services with a term of May 1, 2023 through June 30, 2025 for a not to exceed sum of $4,000, and;

b. Execute up to three (3) future amendments to the Cross Connection Agreement where the total amendments do not exceed ten percent (10%), or $400, of the agreement amount and do not significantly change the scope of work, subject to County Counsel approval.

 

SUMMARY/DISCUSSION:

Lake Nacimiento Resort lies within the County of San Luis Obispo.  The County of Monterey Public Works Facilities and Parks (County) has a need to engage the County of San Luis Obispo (SLO) to provide services for regulatory compliance.  The Environmental Health Services Division of the County of San Luis Obispo’s Public Health Department has been administering the cross-connection control program for the County-owned Lake Nacimiento (Nacimiento). SLO services for regulatory compliance shall include, but not be limited to, conduct a survey and thorough inspection of all water uses for cross-connections; prepare and maintain written survey reports, water user notices, correction notices and follow-up reports, as well as enforcement measures.  During a recent administrative review, SLO could not find an executed agreement with the County to provide this service.

 

Staff requests the Board of Supervisors approve and authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute the proposed non-standard Cross Connection Agreement with SLO (Attachment A) and execute up to three future amendments to the Agreement.

 

OTHER AGENCY INVOLVEMENT:

The Office of County Counsel and Auditor-Controller’s Office reviewed and approved the proposed retroactive Agreement as to form and fiscal provisions, respectively.

FINANCING:

The cost of the contracted services provided by County of San Luis Obispo is not to exceed $4,000 for the term of the Agreement.  There is sufficient funding in the Fiscal Year 2022-23 Adopted Budget in Fund 452, Appropriation Unit PFP060. Future budget requests will request appropriations for this Agreement.
