RECOMMENDATION:
It is recommended that the Board of Supervisors:
a.      Approve and authorize the Director of Health to sign a three fiscal year term (FY 2012-13, 2013-14 and 2014-15) Mental Health Services Agreement with Victor Treatment Centers, Inc. in the amount of $327,302 for FY 2012-13, $280,096 for FY 2013-14 and $280,096 for FY 2014-15, for a total amount of $887,494; and
b.      Authorize the Director of Health to approve up to three (3) future amendments that do not exceed ten percent (10%) of the annual amount, which does not significantly alter the scope of work or result in an increase to General Fund Contribution.
 
SUMMARY/DISCUSSION:
This new Mental Health Service Agreement with Victor Treatment Centers, Inc. ("Victor") replaces Agreement A-11548 which expired on June 30, 2012. Victor will continue to provide Mental Health services, Board and Care and other services required for Monterey County youth in accordance with individual treatment plans and other identified needs.  These services will prevent placement into higher cost inpatient hospitals and out-of-state residential or juvenile justice facilities.  Victor's goals include reducing inappropriate behavioral/emotional symptoms to a level of care whereby the youth can return home or move to a lower level of care.
 
The Department of Social and Employment Services is no longer administering room and board fees for the Special Education Local Plan Area (SELPA). The Behavioral Health Bureau, as lead provider of mental health services to this population of referred students is also administering room and board services and will seek reimbursement from the local SELPA for such services.
 
Execution of this contract has been delayed due to lengthy negotiations seeking modification of the template language.  Victor sought a modification due to the detail and specificity required in the updated contract As indicated in Exhibit J of this Agreement, the parties agreed that Victor shall be responsible to determine on a bi-annual (rather than monthly) basis whether any of its officers, employees, subcontractors, agents, or other individuals or entities are excluded on the S&I (Suspended and Ineligible) list. Victor shall also continue to submit claims on a form acceptable to Behavioral Health rather than submit the new Exhibit G invoice. Lastly, cost control language was modified to allow up to 20% budget variances within categories of expenses (i.e. personnel, operating, indirect) without prior approval Should Victor want to exceed twenty (20%) percent of any contract expense category amount in the budget, then they shall request written approval of Behavioral Health.  Victor was also working with their insurance broker to provide the appropriate insurance documentation as required by the County of Monterey.
 
OTHER AGENCY INVOLVEMENT:
County Counsel, Risk Management, and the Auditor-Controller have reviewed this Agreement as to legal form, insurance requirements, and fiscal provisions respectively. A copy of this Agreement is on file with the Clerk to the Board.
 
FINANCING:
Mental Health services for this Agreement are funded by Medi-Cal (95%) and Realignment revenues for Medi-Cal eligible children (5%). Board and Care services are 100% funded by the Monterey County SELPA. This Agreement is for $327,302 for FY 2012-13, $280,096 for FY 2013-14 and $280,096 for FY 2014-15, for a total amount not to exceed $887,494.  The funds for this Agreement are included in the Health Department's Behavioral Health Bureau (HEA012, Unit 8410) Adopted Budget for Fiscal Year 2012-13. There is no impact to the General Fund with approval of this Agreement.
