a. Approve and authorize the Director of the Emergency Communications Department to sign the Agreement for 9-1-1 Emergency Communications Services and Governance with the cities and fire districts of Monterey County, the Monterey Peninsula Airport District, and other miscellaneous agencies in Monterey County who receive 9-1-1 call taking, dispatching, and other related services from the Emergency Communications Department for an initial term effective upon execution and continuing for a period of three years plus the remainder of the current fiscal year;
b. Approve and authorize an auto-renewal clause; and
c. Authorize the Director of the Emergency Communications Department to sign up to three future amendments to this agreement, including amendments to add new parties, when the amendments are approved by both County Counsel and the Emergency Communication Department’s Executive Board.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Director of the Emergency Communications Department to sign the Agreement for 9-1-1 Emergency Communications Services and Governance with the cities and fire districts of Monterey County, the Monterey Peninsula Airport District, and other miscellaneous agencies in Monterey County who receive 9-1-1 call taking, dispatching, and other related services from the Emergency Communications Department for an initial term effective upon execution and continuing for a period of three years plus the remainder of the current fiscal year;
b. Approve and authorize an auto-renewal clause; and
c. Authorize the Director of the Emergency Communications Department to sign up to three (3) future amendments to this agreement, including amendments to add new parties, when the amendments are approved by both County Counsel and the Emergency Communication Department’s Executive Board.
SUMMARY:
The Monterey County Emergency Communications Department (ECD) is a consolidated public safety answer point (PSAP) and dispatch facility serving 29 law enforcement, fire protection, and emergency medical services (EMS) response agencies throughout Monterey County. The services provided consist of all call taking, dispatching, and other related services. This 911 Services Agreement sets forth the governance and financing of the ECD’s PSAP and dispatch operation and when executed it will replace an existing 9-1-1 Services Agreement with the same parties.
DISCUSSION:
The current 9-1-1 Services Agreement was originally executed in 2020 and has served as the framework for governance and financing of the Emergency Communications Department (ECD). This proposed agreement updates and modernizes the governance structure and responsibilities of ECD and the participating public safety agencies served by the department. It also reflects collaboration with the participating agencies and was reviewed and recommended for approval by the ECD Executive Board prior to being brought forward to the Board of Supervisors.
This proposed agreement clarifies the roles of the two governing bodies that support ECD operations: the Operations Board and the Executive Board. The Operations Board focuses on operational coordination, technology planning, and user issues, and provides recommendations to the Executive Board. The Executive Board reviews governance and financial matters affecting the emergency communications services provided through ECD, while final budget authority for the department remains with the Monterey County Board of Supervisors.
The agreement also clarifies the relationship between ECD and the NGEN Radio System, which is governed under a separate agreement and independent governance structure.
OTHER AGENCY INVOLVEMENT/COMMITTEE ACTIONS:
The Emergency Communications Department Executive Board has reviewed this agreement and distributed it to their constituent agencies for their review. Feedback from all parties has been considered and the Executive Board voted unanimously to have this agreement signed by all parties. County Counsel has reviewed and approved this agreement to legal form. Contracts/Purchasing and the Auditor-Controller have reviewed and approved this agreement. Risk Management has reviewed this agreement as to liability provisions.
FINANCING:
This is a revenue generating agreement and this new agreement will not impact the amounts collected. ECD will continue charging the parties for call-taking, dispatch, and related services.
BOARD OF SUPERVISORS STRATEGIC PLAN GOALS:
This agreement corresponds to the Safe And Resilient Communities Board Of Supervisors Strategic Plan Goal by allowing the Emergency Communications Department to continue operating a consolidated 9-1-1 and Public Safety Dispatch communications center to serve the public safety agencies of Monterey County.
