a. Approve and authorize the Monterey County Laguna Seca Representative to execute a retroactive Standard Agreement between Albert Maldonado dba MP Express and the County of Monterey for design and printing racing-related materials for WeatherTech® Raceway at Laguna Seca with a term beginning July 1, 2021, through December 31, 2023, for an amount not to exceed $45,000; and
b. Approve and authorize the Monterey County Laguna Seca Representative to execute up to three (3) future amendments to the Standard Agreement where the total amendments do not exceed ten percent (10%), or $4,500, of the agreement amount and do not significantly change the scope of work, subject to County Counsel approval.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Monterey County Laguna Seca Representative to execute a retroactive Standard Agreement between Albert Maldonado dba MP Express and the County of Monterey for design and printing racing-related materials for WeatherTech® Raceway at Laguna Seca with a term beginning July 1, 2021, through December 31, 2023, for an amount not to exceed $45,000; and
b. Approve and authorize the Monterey County Laguna Seca Representative to execute up to three (3) future amendments to the Standard Agreement where the total amendments do not exceed ten percent (10%), or $4,500, of the agreement amount and do not significantly change the scope of work, subject to County Counsel approval.
SUMMARY/DISCUSSION:
Albert Maldonado dba MP Express (MP Express) is a local full service commercial printing company that has provided services to WeatherTech® Raceway at Laguna Seca (WRLS) for more than ten years. MP Express understands WRLS’s needs and consistently provides outstanding service and quality products.
This request supports the use of MP Express at WRLS for designing and printing parking and camping passes, and other racing-related materials.
Staff requests the Board of Supervisors approve the proposed retroactive Standard Agreement (Agreement) and authorize the Monterey County Laguna Seca Representative to execute the Agreement and up to three (3) future amendments where the total amendments do not exceed ten percent (10%), or $4,500, of the Agreement amount and do not significantly change the scope of work.
The delay in submitting the proposed Agreement was due to A&D Consulting LLC (A&D) not being informed by the County that an agreement was necessary until after services had been performed in 2021. Previously, an agreement was not needed as printed material was considered a commodity rather than a service. Now, printed materials are considered a service requiring an agreement.
OTHER AGENCY INVOLVEMENT:
The Office of County Counsel and Auditor-Controller’s Office reviewed and approved the proposed retroactive Agreement as to form and fiscal provisions, respectively.
FINANCING:
The cost of the contracted services provided by MP Express is not to exceed $45,000 for the duration of the Agreement. These printing costs are included in the Fiscal Year 2021-22 Adopted Budget in Fund 453, Unit 8536, Appropriation Unit CAO046. Future costs for the remainder of this Agreement will be included in the respective fiscal year recommended budgets
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The recommended action supports the Board of Supervisors Strategic Initiative for Economic Development. The printing of event publications and materials distributed to the community helps stimulate revenue for Laguna Seca Recreational Area which, in turn, stimulates the local economy.
