a. Approve and authorize the Monterey County Laguna Seca Representative to execute a retroactive Amendment #1 to Agreement A-15535, Fixed Term Vehicle Storage Agreement between Allen Berg Racing School and the County of Monterey, to increase storage space for WeatherTech® Raceway at Laguna Seca and increase the monthly rent to two thousand eight hundred eighty dollars ($2,880), effective December 1, 2021, and to extend the term of the Agreement through June 30, 2023.
b. Approve and authorize the Monterey County Laguna Seca Representative to execute up to three (3) future amendments to this Agreement where the total amendments do not exceed 10% ($288) of the Agreement amount and do not significantly change the scope of work, subject to County Counsel approval.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Monterey County Laguna Seca Representative to execute a retroactive Amendment #1 to Agreement A-15535, Fixed Term Vehicle Storage Agreement between Allen Berg Racing School and the County of Monterey, to increase storage space for WeatherTech® Raceway at Laguna Seca and increase the monthly rent to two thousand eight hundred eighty dollars ($2,880), effective December 1, 2021, and to extend the term of the Agreement through June 30, 2023.

SUMMARY/DISCUSSION:
Allen Berg Racing School (ABRS) is the only formula car racing school in North America to feature a former Formula One World Championship driver as an active coach. Founder Allen Berg conducts highly regarded racing school programs at WeatherTech® Raceway at Laguna Seca (WRLS) using state-of-the-art carbon fiber race cars. ABRS stores its race cars at Laguna Seca near Turn 11.
The County and ABRS entered into a Fixed Term Vehicle Storage License Agreement (Agreement), with a term commencing on October 18, 2021 and ending on June 30, 2022, for five (5) 8'x40' storage containers with a security fence surrounding the property for a monthly rental of $2,400 (Attachment A). In December 2021, ABRS requested the storage of an additional storage container and A&D Narigi Consulting, LLC (A&D), the County’s contracted manager of WRLS, allowed the storage of the additional storage container, and ABRS has paid the increased monthly rental without an approved amendment to the License, which created a retroactive condition. The proposed retroactive Amendment #1 to the Agreement A-15535 (Attachment B) adds an additional storage container with a fee of $480 per month to the Agreement for a new monthly rent fee of $2,880 and extends the Agreement through June 30, 2023.
Staff requests the Board of Supervisors approve the proposed retroactive Amendment #1 and authorize the Monterey County Laguna Seca Representative to execute the proposed retroactive Amendment #1 and up to three future amendments to Agreement A-15535.
OTHER AGENCY INVOLVEMENT:
The Office of County Counsel reviewed and approved the proposed retroactive Agreement as to form. Risk Management reviewed and approved the insurance coverage and limits.
FINANCING:
Agreement A-15535 is revenue generating for Fund 453 Laguna Seca Budget.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The recommended action supports the Board of Supervisors Strategic Initiatives for Economic Development and Administration. Use of the services will assist in retaining a driving school at WRLS and improve the effectiveness of County Parks’ services. This, in turn, will generate revenue to sustain the park facility and promote economic development by attracting domestic and international visitor dollars that will stimulate the local economy.
