Title

Adopt a resolution to both approve amendments to and revise Community Health Services’ Conflict of Interest Code.

 

Report

RECOMMENDATION:

Staff recommends that the Board of Supervisors, as the code reviewing body under the Political Reform Act, both approve amendments to and revise, Community Health Services’ Conflict of Interest Code.

 

SUMMARY:

Community Health Services amended its Conflict of Interest Code to add a new designated position. A copy of its amended Conflict of Interest Code is appended hereto as Attachment B.

 

DISCUSSION:

Amendments to local agency Conflict of Interest Codes are authorized by section 87306 of the Government Code whenever changes are required by changed circumstances, by creation or deletion of designated positions, or by changes in the duties of designated positions. 

 

Under Government Code sections 82011 and 87303, the Board of Supervisors is the code reviewing body.  It may approve the Code as submitted; revise the proposed code and approve it as revised; or return the proposed Code to the agency for revision and resubmission.

 

The Office of the County Counsel recommends that the Board revise the proposed Conflict of Interest Code of the Community Health Services to add the following language:

 

 “The jurisdiction of Community Health Services is entirely within the County of Monterey.”

 

The statement of geographical jurisdiction of Community Health Services establishes that the Board is the appropriate code reviewing body.

 

Staff recommends that the Board adopt and approve Community Health Services’ amended Conflict of Interest Code as revised.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel has reviewed the amended Conflict of Interest Code of Community Health Services. The amended Code is lawful under the Political Reform Act of 1974, as revised.

 

FINANCING:

There is no fiscal impact upon the County of Monterey resulting from the Board’s revision and approval of the proposed Conflict of Interest Code.

 

BOARD OF SUPERVISORS’ STRATEGIC INITIATIVES:

Revision and approval of the proposed Conflict of Interest Code fulfills the Board’s statutorily designated role as the code reviewing body pursuant to the Political Reform Act.
