Approve and authorize the Contracts/Purchasing Officer or designee to execute Amendment No. 2 to the Standard Agreement with San Miguel Garbage Co., Inc. to provide solid waste containers and solid waste and recycling collection services at Lake Nacimiento Resort, extending the term through February 25, 2029, for a revised term of February 26, 2019, to February 25, 2029; and increasing the amount not to exceed by $467,788 with an amended not to exceed total of $885,357; and,
b. Approve and authorize the County Purchasing Officer or designee to execute up to three future amendments to the Agreement where the total amendments do not exceed 10% ($88,535) of the Agreement’s not to exceed sum for an aggregate total not to exceed of $973,893 and does not significantly change the scope of work, subject to County Counsel approval.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Contracts/Purchasing Officer or designee to execute Amendment No. 2 to the Standard Agreement with San Miguel Garbage Co., Inc. to provide solid waste containers and solid waste and recycling collection services at Lake Nacimiento Resort, extending the term through February 25, 2029, for a revised term of February 26, 2019, to February 25, 2029; and increasing the amount not to exceed by $467,788 with an amended not to exceed total of $885,357; and,
b. SUMMARY/DISCUSSION:
San Miguel Garbage Co., Inc. (San Miguel) is a solid waste/refuse removal and recycling contractor that has provided services in San Luis Obispo County for over fifty (50) years. It is a family owned and operated business offering a variety of state-of-the-art services including automated waste and recycling collection, green waste recycling programs, transfer and materials recovery, and storage box rentals.
The County executed a Standard Agreement (Agreement) with San Miguel for solid waste and recycling collection services at Lake Nacimiento Resort on March 1, 2019 (Attachment A) and Amendment No. 1 to increase the not to exceed amount on January 4, 2023 (Attachment B). County continues to need the services of San Miguel. Staff confirmed San Miguel remains the only provider serving the geographical area at Lake Nacimiento and there is no alternative service for refuse removal. The proposed Amendment No. 2 will extend the Agreement through February 25, 2029, and increase the not to exceed sum to $885,357 (Attachment C).
Staff requests the Board of Supervisors approve and authorize the Contracts/Purchasing Officer or designee to execute the proposed Amendment No. 2 to the Standard Agreement with San Miguel, extending the term from February 26, 2019 through February 25, 2029, and increase the not to exceed amount to $885,357; and approve and authorize the County Purchasing Officer or designee to execute up to three future amendments to the Agreement where the total amendments do not exceed 10% ($88,535) of the Agreement’s not to exceed sum for an aggregate total of $973,893.
OTHER AGENCY INVOLVEMENT:
The Offices of the County Counsel and Auditor-Controller have reviewed and approved Amendment No. 2 as to form and legality and fiscal provisions, respectively.
FINANCING:
The amended total not to exceed amount of the Standard Agreement between the County and San Miguel Garbage Co., Inc. is $885,357, after considering total increase of $467,788 proposed on Amendment No. 2 for the extended agreement term.
There are sufficient appropriations available in the PWFP Adopted Budget in Fiscal Year (FY) 2024 for Lake Nacimiento Resort (Fund 452, Department 3200, Unit 8565, Appropriations Unit PFP060) to cover the additional fees for FY 2024. The proposed not to exceed amount of $467,788 is intended to allow services to continue in future fiscal years.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The recommended action supports the Board of Supervisors’ Strategic Initiatives as indicated below. Providing solid waste containers, and collection of solid waste and recycling generated from camping and use of the property is a required service.
