a. Approve Amendment No. 2 to Professional Services Agreement No. A-12163 with EMC Planning Group, Inc. where there is no increase to the Base budget amount of $1,002,022 or the Contingency budget amount of $118,950 for a total amount not to exceed $1,120,972 to allow for the addition of a new task in the amount of $5,610 to address revisions to a Nighttime Noise Control Ordinance related to implementation of the 2010 Monterey County General Plan (RFP #10287) for a term to June 30, 2015; and
b. Authorize the usage of Contingency budget funds for the payment of the new task associated with the revision of a Nighttime Noise Ordinance related to implementation of the 2010 Monterey County General Plan (RFP #10287) in the amount of $5,610; and
c. Authorize the Contracts/Purchasing Office to execute Amendment No. 2 to Professional Services Agreement No. A-12163 and future amendments to the Agreement where the amendments do not significantly alter the scope of work or change the approved Agreement amounts.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 2 to Professional Services Agreement No. A-12163 with EMC Planning Group, Inc. where there is no increase to the Base budget amount of $1,002,022 or the Contingency budget amount of $118,950 for a total amount not to exceed $1,120,972 to allow for the addition of a new task in the amount of $5,610 to address revisions to a Nighttime Noise Control Ordinance related to implementation of the 2010 Monterey County General Plan (RFP #10287) for a term to June 30, 2015; and
b. Authorize the usage of Contingency budget funds for the payment of the new task associated with the revision of a Nighttime Noise Ordinance related to implementation of the 2010 Monterey County General Plan (RFP #10287) in the amount of $5,610; and

DISCUSSION:
Amendment No. 2 to the PSA with EMC Planning Group, Inc. provides for a new task to address revisions to a Nighttime Noise Control Ordinance related to implementation of the 2010 General Plan and allows for funding to be paid from the Contingency budget approved in the original PSA for the new task in the amount of $5,610. The term of this PSA is from December 20, 2011 to June 30, 2015.

FINANCING:
The total Base budget amount of this PSA is $1,002,022 with a Contingency budget of $118,950 for a total amount not to exceed $1,120,972. Amendment No. 2 to the PSA includes a new task but does not increase the budget amounts identified in the original Agreement. The $5,610 cost associated with the new task included in Amendment No. 2 to the PSA will be paid from the established Contingency budget.
The Resource Management Agency - Planning has worked with the County Administrative Office - Budget and Analysis Division to determine the most appropriate source of funding for the 2010 Monterey County General Plan implementation. There is sufficient funding available in Fund 001, Unit 8038 - Other Financing Uses to finance the remaining Base and Contingency budgets of the PSA as amended by Amendment No. 2.
