a. Ratify and authorize the Contracts/Purchasing Officer to sign an Agreement with the County of Santa Clara in the amount of $20,000, for the period of July 1, 2014 to June 30, 2019, to provide confirmatory testing on specimens being tested for HIV, Syphilis, Blood Lead and other diseases or conditions for the Monterey County Health Department's Laboratory; and
b. Accept and approve the non-standard language and risk provisions; and
Authorize the Contracts/Purchasing Officer to approve up to three future amendments to this Agreement where the total amendment amounts do not exceed ten percent (10%) of the contract amount and do not significantly alter the scope of services.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Ratify and authorize the Contracts/Purchasing Officer to sign an Agreement with the County of Santa Clara in the amount of $20,000, for the period of July 1, 2014 to June 30, 2019, to provide confirmatory testing on specimens being tested for HIV, Syphilis, Blood Lead and other diseases or conditions for the Monterey County Health Department's Laboratory; and
b. Accept and approve the non-standard language and risk provisions; and

SUMMARY/DISCUSSION:
This Standard Agreement is to obtain reference laboratory services from the County of Santa Clara's Public Health Laboratory (CSCLAB) for testing specimens for infectious diseases. The Monterey County Health Department's Laboratory (MCHD) utilizes CSCLAB to perform tests that are infrequently ordered (such as Syphilis serology, HIV serology and Blood Lead levels). MCHD outsources these tests because: 1) MCHD cannot adequately maintain quality for these low volume procedures; 2) MCHD cannot provide results as quickly; and, 3) MCHD cannot perform the test efficiently because the required diagnostic test kits expire before use. The cost of test kits exceeds the cost of referral of the specimen to a reference lab.
This work supports the Monterey County Health Department 2011-2013 Strategic Plan Initiative No.3, Ensure access to culturally and linguistically appropriate, customer-friendly, quality health services.
OTHER AGENCY INVOLVEMENT:
County Counsel, Risk Management and the Auditor-Controller have reviewed this Agreement as to legal form, liability and fiscal provisions respectively. Due to the non-standard language and non-standard risk provisions, it was recommended that the Health Department request approval from the Board of Supervisors. A copy of Agreement is on file with the Clerk of the Board.
FINANCING:
All costs for these outsourced laboratory tests are added to the client's fees and received by the
Health Department as revenue. There are sufficient appropriations included in the Health Department's (HEA003-8124) Adopted Budget for Fiscal Year 2014-15.
