RECOMMENDATION:
It is recommended that the Board of Supervisors adopt a resolution to:
a. Approve a Master Agreement between the Transportation Agency for Monterey County and the County of Monterey for Regional Surface Transportation Program Exchange Funds for County projects; and
b. Authorize the Director of Public Works, or his designee, to act as the agent for the County to execute documents to secure these funds from Transportation Agency for Monterey County.
SUMMARY:
The attached Master Agreement (Agreement) between the Transportation Agency for Monterey County (TAMC) and the County of Monterey (County) details state requirements for Regional Surface Transportation Program (RSTP) funds and other fiscal provisions required to comply with State and Federal regulations. Said Agreement will need to be fully executed along with a list of proposed projects to receive RSTP funds. RSTP funds are reimbursable and are subject to audit by an independent certified public accountant and by the State of California. If approved, the Master Agreement will be updated every three years.
DISCUSSION:
The RSTP was established by the California State Statute utilizing Surface Transportation Program funds that are identified in section 133 of Title 23 of the United States Code. As authorized by section 182.6 (g) of the Streets and Highways Code, TAMC has entered into an agreement with the State of California, to assign a portion of its annual RSTP apportionment to Caltrans in exchange for State funds. These exchanged funds are allocated to local agencies to implement projects.
The purpose of the RSTP program is to provide funding to local agencies for a wide variety of transportation planning and improvement projects, such as research, planning, construction, improvement, maintenance, and operation of public streets and highways (and their related public facilities for non-motorized traffic). Eligible projects include those authorized under sections 133(b) and 133(c) of Title 23, United States Code and Article XIX of the California State Constitution.
TAMC distributes RSTP through competitive and fair-share programs. The RSTP Competitive funds are distributed through a competitive grant process and RSTP fair-share funds are distributed to local jurisdictions based on their urbanized populations.
TAMC is soliciting RSTP competitive grant applications for the FY 2014/15 - 2016/17 cycle. Applications are due to TAMC on May 1, 2014. If funds are awarded to the County, staff will return to the Board of Supervisors for acceptance of the grant funds.
The County of Monterey's 2014 RSTP Fair-Share Reserve for fiscal years 2014/15 - 2016/17 is $1,329,667 or $443,222 annually (see Exhibit A of Agreement). The Department anticipates using these funds on roadway maintenance and operational improvements and to match Federal and State grants.
Additionally, Exhibit A lists an allocation of $100,000 in Transportation for Livable Communities (TLC) grant funds (RSTP competitive grant) awarded by the TAMC Board on January 22, 2014, for the Rico Street Sidewalk Improvements Project in the Community of Castroville.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel, and Risk Management, have reviewed the Master Agreement as to form, and insurance provisions, respectively. On March 26, 2014, the TAMC Board of Directors approved the RSTP Master Agreement.
FINANCING:
There is no financial impact to the General Fund. RSTP grant funds do not require a local match. The annual amount received would be recognized in Fund 002.
