RECOMMENDATION:
It is recommended that the Board of Supervisors:
 
a. Approve a Road Improvement Agreement and Road Maintenance Agreement, between the County of Monterey and Bastogne Holdings, LLC, in compliance with Combined Development Permit No. PLN110426, 1083 Madison Lane, Salinas, Greater Salinas Area Plan; and
 
b. Authorize the Chair of the Board to execute the Road Improvement Agreement and Road Maintenance Agreement.
 
SUMMARY/DISCUSSION:
On June 13, 2012, the Planning Commission of Monterey County approved Use Permit PLN110426 for Bastogne Holdings, LLC to allow the storage and distribution of petroleum products on an existing heavy commercial site.  To address impacts to the transportation system, the following Conditions of Approval were placed on the project: Road Improvement Agreement (Condition No. 14), Encroachment Permit (Condition 17), and Road Maintenance Agreement (Condition No. 13).  
 
Condition No. 14 requires the applicant to enter into a Road Improvement Agreement with the County, to install curb, gutter, sidewalk and pave-out along the frontage of Madison Lane.  Condition No. 17 requires the applicant to obtain an Encroachment Permit to construct curb, gutter, sidewalk and pave-out along the frontage of Madison Lane.  
 
Condition No. 13 requires the applicant to enter into a Road Maintenance Agreement with the County, to pay a proportionate share of the road maintenance costs of Madison Lane and Boronda Road.  The proportionate share for Madison Lane was determined in the applicant's traffic report prepared by Hatch Mott MacDonald, Inc. as required by the Resource Management Agency-Public Works.
 
The agreements require the applicant to construct frontage improvements on Madison Lane in combination with the development of the permitted project and contribute toward future road maintenance, satisfying Conditions 13 and 14.
 
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel, and Risk Management, have reviewed and approved the Road Improvement and Maintenance Agreements as to form, and insurance provisions, respectively.
 
FINANCING:
There is no financial impact to the General Fund.  All associated costs are funded by the Road Maintenance Agreement.  Prior to July 1st of each year, the applicant will pay to the Resource Management Agency-Public Works (RMA-PW) their proportionate share of road maintenance costs.  This will increase RMA-PW maintenance obligation by $1,117.58.  Payments under the Maintenance Agreement will be placed in the Road Fund Maintenance Budget Unit 8443.
