RECOMMENDATIONS:

It is recommended that the Board of Supervisors: 

a. Authorize an additional contingency of 20% of the original contract amount or $450,140 for a total contingency of 40% ($900,280) with Anderson Pacific Engineering Construction, Inc. for the Hartnell Road Bridge at Alisal Creek, County Bridge No. 209, State Bridge No. 44C-110, Project No. 385465, State Project No. EA 05-00020138LN, Federal Aid Project No. BRLO-5944 (103) to provide funding for approved contract change orders to repair areas within the project site that sustained flood damage during recent winter storms; and 

b. Authorize the Director of Public Works, Facilities, and Parks to execute contract change orders where the overall all total value of change orders does not exceed 40% of the original contract amount and does not significantly change the scope of work.

 

SUMMARY/DISCUSSION:

The Hartnell Road Bridge at Alisal Creek Replacement Project, (County Bridge No. 209, Federal Aid Project No. BRLO-5944 (103), Project No. 385465) consists of removing the existing bridge, constructing a new two-lane bridge on the existing alignment, approach embankment grading, paving, associated improvements on Hartnell Road and realignment of the Alisal Creek.  On May 24, 2022, the Board of Supervisors awarded a contract to Anderson Pacific Engineering Construction, Inc. (Contractor) in the amount of $2,250,698 to construct the project.  As part of its action, the Board also authorized a contingency, not to exceed 10% of the contract amount or $225,070 to provide funding for approved contract change orders.

 

Construction began on June 24, 2022, and was expected to be completed by the end of February of 2023.   However, beginning on December 12, 2022, and through March 2023, the project site experienced flooding from several high intensity storms that damaged the recently constructed improvements.  To minimize further damage to the Project, the County directed the Contractor to stop contract construction activities, and immediately perform emergency repairs. 

 

At the January 31, 2023 meeting, the Board approved staff’s recommendation to fund the emergency repairs by increasing the Project contingency by $225,070 (10% of the original contract amount).  The total contingency amount was increased to $450,140 or 20% of the original contract amount.

 

To complete the Project, additional design and construction work is necessary to address the change in site conditions resulting from the flooding which began on December 12, 2022, and continued through March 2023, and necessary emergency repairs.  To complete the Project during this construction season, this work needs to start on or about June 1, 2023, after the County obtains the necessary permits from the regulatory agencies to access Alisal Creek.  PWFP staff is requesting an additional 20% contingency or $450,140 to fund the work necessary to complete the project.  

 

PWFP staff is working with Caltrans to secure funding to cover the additional cost associated with Federal Highway Administration (FHWA) and State Toll Credits funds.  

OTHER AGENCY INVOLVEMENT:

PWFP staff is coordinating with Caltrans staff to secure additional funding. 

FINANCING:

The total project costs to date, including engineering, environmental, and construction totals $5,119,173.  The Project is financed by the FHWA ($4,534,829), Toll Credit Fund ($587,535), and Measure X ($352,850). The proposed additional 20% contingency ($450,140), will result in a total Project contingency of 40%, or $900,280.  There are sufficient appropriations in the FY 2023-24 Annual Work Program for Road Fund, Fund 002, PFP004, for this increase. 

The proposed additional contingency amount of $450,140 will cover the additional costs to complete the Project.  PWFP staff is coordinating with Caltrans staff to secure additional funding with federal and state funds.   If additional funding cannot be obtained, Measure X funds could be used to cover the additional costs.
