b. Authorize the Director of Health to execute Amendment No. 8 to the Agreement between the County of Monterey and American Medical Response West for the provision of Advanced Life Support Ambulance Services for the County of Monterey effective February 1, 2013.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Ratify and approve Amendment No. 8 to the Agreement between the County of Monterey and American Medical Response West for the provision of Advanced Life Support Ambulance Services for the County of Monterey to replace Exhibit B Monterey County Ambulance Rate Tables to said Agreement to correct a typographical error, effective February 1, 2013; and
b. Authorize the Director of Health to execute Amendment No. 8 to the Agreement between the County of Monterey and American Medical Response AMR for the provision of Advanced Life Support Ambulance Services for the County of Monterey effective February 1, 2013.
SUMMARY:
The Director of Health seeks authorization to execute Amendment No. 8 to the Agreement between the County of Monterey and American Medical Response West for the provision of Advanced Life Support Ambulance Services for the County of Monterey to replace Exhibit B Monterey County Ambulance Rate Tables to said Agreement in order to reflect the correct rate $62.55 for Pulse Oximetry, as approved by the Board on January 29, 2013.
DISCUSSION:
On December 15, 2009, the Board of Supervisors awarded the Agreement for the provision of Advanced Life Support Ambulance Services for the County of Monterey to American Medical Response West (AMR-West). The original contract included an Exhibit B (Monterey County Ambulance Rates Table), which listed the ambulance base rates and rates for ambulance supplies. Exhibit B, (Monterey County Ambulance Rates Table) listed the price for Pulse Oximetry as $60.88.
On January 29, 2013, the Board of Supervisors approved the execution of Amendment No. 3 to amend and replace Exhibit B (Monterey County Ambulance Rates Table) with a new Exhibit B, which increased ambulance rates by 2.75%, based upon the Consumer Price Index-escalator in the contract. This rate increase became effective on February 1, 2013. The approval of a 2.75% rate increase increased the new price for Pulse Oximetry from $60.88 to $62.55 (a 2.75% increase from the previous rate). Unfortunately, due to a typographical error, the Pulse Oximetry rate on Exhibit B (Monterey County Rate Table), that was to go into effect as of February 1, 2013, was listed as $52.28.
On December 16, 2014, the Board of Supervisors approved the execution of Amendment No. 7 to authorize a fifth one-year contract extension with AMR for the period of January 31, 2019 through January 31, 2020, and amended the Exhibit B (Monterey County Ambulance Rates Table) with a new Exhibit B, which increased the ambulance standby rate by $10.00. All other charges were to remain the same as approved by the Board in 2013. The Exhibit B attached to Amendment No. 7 also listed the Pulse Oximetry rate as $52.28.
On October 14, 2015, Doug Petrick, AMR-West General Manager, reported to the Monterey County Emergency Medical Services (EMS) Agency that a routine audit of the Agreement between Monterey County and AMR-West identified that AMR-West was charging a rate of $62.55 for pulse oximetry, which is greater than the $52.28 rate listed in Exhibit B approved by the Board of Supervisors on January 29, 2013. The EMS Agency reviewed the rates approved by the Board of Supervisors on December 15, 2009, January 29 2013, and December 16, 2014, and confirmed that Exhibit B (Monterey County Ambulance Rates Table) has contained a typographical error, listing the rate for Pulse Oximetry as $52.28 instead of the $62.55 rate, the rate in effect as of February 1, 2013 per the Board’s approval.
While this work is not directly in support of a Health Department strategic initiative, it is in support of one or more of the ten essential public health services, specifically: (6) Enforce laws and regulations that protect health and ensure safety and (7) link people to needed personal health services and assure the provision of health care when otherwise unavailable.
