Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.                     Approve and authorize the Director of Health Services or their designee to sign an Agreement with Bayside Oil II, Inc., for used oil and filter collection, hauling, and recycling for the amount of $40,000, retroactive to July 1, 2023, through June 30, 2025;

b.                     Accept non-standard risk provisions (indemnity/insurance) as recommended by the Director of Health Services; and

c.                     Approve and authorize the Director of Health Services or their designee to execute up to three (3) future amendments that do not exceed 10% ($4,000) of the original Agreement and to make changes to Exhibit B as needed specific to Collection Centers and that does not significantly change the scope of services.

 

SUMMARY:

The Health Department's Environmental Health Bureau coordinates a countywide Used Oil and Filter Collection and Recycling Program.  The State of California’s Department of Resources Recycling and Recovery (CalRecycle) provides annual funding to local jurisdictions to implement their Used Oil and Filter Collection and Recycling Programs.  Bayside Oil II, Inc. acts as the County’s collector, hauler, and recycler for used oil and filters. 

 

DISCUSSION:

Since 1994 Monterey County, through the Health Department's Environmental Health Bureau, has administered a countywide Used Oil and Filter Collection and Recycling Program.  This program promotes the proper disposal and recycling of used motor oil and oil filters for residents in Monterey County.  The County provides community education and makes various outlets available for the proper disposal and recycling of used motor oil and oil filters available through curbside collection and residential drop-off centers.

 

CalRecycle is authorized to make payments to qualifying local jurisdictions for implementation of their used oil programs.  These funds are used to cover costs related to personnel time, acquisition of equipment, supplies, and training to enhance Used Motor Oil and Filter Recycling Program activities.  Bayside Oil II, Inc. provides hauling services from Collection Centers for used oil and filters as part of this program.  “Exhibit B” identifies the Collection Centers which may change from time to time.  In addition to approval of the agreement, authorization is requested to amend Exhibit B to adjust Collection Centers as needed when added or deleted. 

 

Business Automobile Liability Insurance and Indemnification provisions have been revised to include the addition of Hazardous Materials and Environmental Insurance and/or Pollution Legal Liability Coverage provisions to address the transportation of hazardous materials. 

 

This work supports the Monterey County Health Department 2018-2022 Strategic Plan Goal (1.) to empower the community to improve health.  It also supports the following of the ten essential public health services, specifically (3.) inform, educate, and empower people about health issues and (4.) mobilize community partnerships and action to identify and solve health problems.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel has reviewed and approved this Agreement as to form and legality. 

 

FINANCING:

There is no impact to the General Fund resulting from this Board action.  This agreement is funded by CalRecycle’s used oil program grant. There are sufficient appropriations in the Environmental Health’s Fiscal Year (FY) 2023-24 Adopted Budget.  For the FYs out, provision will be made in the Requested Budget for the appropriate year.
