RECOMMENDATION:
It is recommended that the Board of Supervisors:
a.       Authorize the Contracts/Purchasing Officer to approve and sign a Professional Services Agreement with Zachary Botterman, for the period of March 15, 2015 through June 30, 2017 for modification, maintenance, continued development, and ongoing revisions to the Monterey County Emergency Medical Services (EMS) Agency smart phone application, in the total amount of $120,000; and,
b.      Authorize the modification of the County standard insurance requirements pertaining to General Liability Insurance and Business Automobile Liability Insurance.
 
SUMMARY/DISCUSSION:
The proposed Professional Service Agreement represents the contractual instrument that will permit the County to engage the services of a software developer to continue to improve the software application for use on Android and Apple platform devices.  .  
 
The Department is requesting a modification of the County's requirements for General Liability and Automotive Insurance.  The Monterey County Purchasing Officer, Mike Derr, and Director of EMS, Kirk Schmitt do not feel there is any inherent risk of liability exposure with the waiver of these insurance requirement.   
 
While this work is not directly in support of a Health Department strategic initiative, it is in support of one or more of the ten essential public health services, specifically: (6) Enforce laws and regulations that protect health and ensure safety and (7) link people to needed personal health services and assure the provision of health care when otherwise unavailable.
 
OTHER AGENCY INVOLVEMENT:
County Counsel and the Auditor Controller have reviewed the Agreement as to legal form and fiscal provisions respectively.  A copy of the Agreement and Exhibits A and B are on file with the Clerk of the Board.
 
FINANCING:
Costs for this Agreement are included in the Board approved 4000-8109-HEA006 FY 2014-15 budget and will be included in the requested budgets for FY 2015-16 and FY2016-17.  This Agreement will have no impact on the Department's General Fund Contribution.
