RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
a. Ratify Amendment No. 1 to Professional Services Agreement with EMC Planning Group,
Inc. to provide an additional Biological Report for the coastal permit application package
and preparation of a proof draft of the Natural Environment Study, Visual Impact
Assessment, and Initial Study and Mitigated Negative Declaration for the Blackie Road
Safety Improvements Project, Phase II, Project No. 142265, in the amount of $4,781.50 for
a total amount not to exceed $56,164.50 for a term through December 31, 2011; and
b. Authorize the Contracts/Purchasing Officer to execute Amendment No. 1 to Professional
Services Agreement.
SUMMARY/DISCUSSION:
On October 9, 2009, the Contracts/Purchasing Officer executed a Professional Services
Agreement PSA) with EMC Planning Group, Inc. in the amount of $51,383 to provide
environmental services including CEQA and NEPA compliance for the Blackie Road Safety
Improvements, Phase II, Project No. 142265 for a term from October 15, 2009 through
December 31, 2011.
Amendment No. 1 provides funds to pay EMC Planning Group, Inc. for services already
provided. These services included the preparation of the Natural Environmental Study, Visual
Impact Assessment, and Initial Study and Mitigated Negative Declaration; and the preparation of
an additional Biological Report requested by the County Planning Department, required for the
coastal permit application package. Due to the urgency and time constraints involved in
presenting the environmental documents to the Coastal Commission, Planning Commission,
Coastal Land Use Committee and Non-Coastal Land Use Committee for approval, EMC
Planning Group, Inc. was allowed to proceed and prepare the additional Biological Report.
Amendment No. 1 will increase this Agreement by $4,781.50 for a total amount not to exceed
$56,164.50.
OTHER AGENCY INVOLVEMENT:
County Counsel, Auditor-Controller, and Contracts/Purchasing Offices have reviewed and
approved Amendment No. 1 as to form and fiscal provisions, respectively.

BETWEEN COUNTY OF MONTEREY AND
EMC PLANNING GROUP, INC.
THIS AMENDMENT NO. 1 to the Professional Services Agreement between the County of
Monterey, a political subdivision of the State of California hereinafter, County"), and EMC
PLANNING GROUP, INC. hereinafter, CONTRACTOR") which was executed by the County
on October 9, 2009 hereinafter, Agreement") is hereby entered into between the County and
the CONTRACTOR.
WHEREAS, the County and the CONTRACTOR wish to amend the Agreement to include an
additional Biological Report for the coastal permit application package and preparation of a
proof draft of the Natural Environment Study, Visual Impact Assessment, and Initial Study and
Mitigated Negative Declaration, and
WHEREAS, the County and the CONTRACTOR wish to amend the Agreement to provide
funding to pay the Contractor for those services previously rendered.
NOW, THEREFORE, the parties agree to amend the Agreement as follows:
1. Amend Paragraph 1, Services to be Provided", to read as follows:
The County hereby engages CONTRACTOR to perform, and CONTRACTOR hereby
agrees to perform, the services described in Exhibits A and A-1, in conformity with the terms of
this Agreement. The services are generally described as follows: provide environmental
services including CEQA and NEPA compliance, prepare an additional Biological Report for the
coastal permit application package; and prepare a proof draft of the Natural Environment Study,
Visual Impact Assessment, and Initial Study and Mitigated Negative Declaration for the Blackie
Road Safety Improvements Project, Phase II
Amend Paragraph 2, Payments by County", to read as follows:
County shall pay the CONTRACTOR in accordance with the payment provisions set forth in
Exhibits A, and A-l, subject to the limitations set forth in this Agreement. The total amount
payable by County to CONTRACTOR under this Agreement is amended to increase the total
amount payable to CONTRACTOR by $4,781.50, for a total not to exceed amount of
$56,164.50.

Dear Barmy:
Attached is a revised budget spreadsheet reflecting the costs for the additional tasks
requested of and performed by EMC Planning Group that are beyond the.scope of work and
budget of. the approved PSA for the Blackie Road II Safety Improvements Project. As you
are aware, additional tasks were requested by County staff after our kickoff meeting, Due to
the accelerated timeline for this project and the time needed by County staff to process a
contract amendment, EMC agreed to prepare the following items in good faith without
waiting for an approved amendment to the Professional Service Agreement PSA). The
additional items requested by County staff are as follows.
Planning Department: Prepare" an additional Biological Report for the- coastal permit
application package. Provide a CD copy of the CEQA Document.
Department of Public Works: Prepare a proof draft of the Natural Environment Study,
Visual Impact Assessment and Initial Study and Mitigated Negative Declaration fort.final
review by the Director of Public Works,
This PSA amendment is requested to offset the additional staff time and production costs
incurred by EMC Planning Group to comply with staffs requests for the additional copies,
preparation and production of the additional report, and additional analysis.
