Title

Adopt a resolution to revise and approve amendments to, and revise, the Public Works, Facilities and Parks Department of the County of Monterey’s Conflict of Interest Code.

RECOMMENDATIONS:

Staff recommends that the Board of Supervisors, as the code reviewing body under the Political Reform Act, approve amendments to and adopt the Public Works, Facilities and Parks Department of the County of Monterey’s Conflict of Interest Code.

 

SUMMARY:

Following the biennial review of its Conflict of Interest Code (Code) as required by Government Code section 87306.5, Public Works, Facilities and Parks amended its Conflict of Interest Code  necessitated by eliminated, added and revised position classifications. A copy of its amended Conflict of Interest Code is appended hereto as Attachment B.

 

DISCUSSION:

Amendments to local agency Conflict of Interest Codes are authorized by section 87306 of the Government Code whenever changes are required by changed circumstances, by addition or deletion of designated positions, or by changes in the duties of designated positions.

 

Under Government Code sections 82011 and 87303, the Board of Supervisors is the code reviewing body.   It may approve the Code as submitted; revise the proposed code and approve it as revised; or return the proposed Code to the agency for revision and resubmission.

 

Staff recommends that the Board adopt and approve Public Works, Facilities and Parks, Department of the County of Monterey’s amended Conflict of Interest Code.

 

OTHER AGENCY INVOLVEMENT:

County Counsel has reviewed the amended Conflict of Interest Code of PWFP. The amended Code is lawful under the Political Reform Act of 1974. 

 

FINANCING:

Approval of this amended Conflict of Interest Code will have no financial impact upon the County of Monterey.
