a. Approve and authorize the Monterey County Laguna Seca Representative to execute a retroactive Amendment No. 2 to the Standard Agreement with Star Sanitation, LLC to continue to provide sanitation units and service for fixed restroom structures for WeatherTech® Raceway at Laguna Seca, Request for Proposals #10704, to extend the Agreement term to July 1, 2019 through March 31, 2025 and increase the not to exceed sum by $220,000 for an amended not to exceed sum of $1,320,000; and
b. Approve and authorize the Monterey County Laguna Seca Representative to execute future amendments to the Agreement where the total amendments do not exceed 10%, or $132,000 of the total agreement amount and do not significantly change the scope of work, subject to County Counsel approval for a total aggregate sum of $1,452,000.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Monterey County Laguna Seca Representative to execute a retroactive Amendment No. 2 to the Standard Agreement with Star Sanitation, LLC to continue to provide sanitation units and service for fixed restroom structures for WeatherTech® Raceway at Laguna Seca, Request for Proposals #10704, to extend the Agreement term to July 1, 2019 through March 31, 2025 and increase the not to exceed sum by $220,000 for an amended not to exceed of sum $1,320,000; and
b. SUMMARY/DISCUSSION:
Star Sanitation, LLC (Star Sanitation), a local company, was selected to provide portable sanitation units and cleaning service for fixed restroom structures at WeatherTech®Raceway at Laguna Seca (WRLS) during a competitive selection process through Request for Proposals (RFP) #10704 in accordance with County policies and all local, state, and federal laws. On June 18, 2019, the Standard Agreement was executed with a five-year term from July 1, 2019 through June 30, 2024 with a total not to exceed sum of $750,000 (Attachment A). Amendment No. 1 was executed October 27, 2022 to increase the not to exceed sum by $350,000 to an amended not to exceed sum of $1,100,000 (Attachment B). The proposed Amendment No. 2 will increase the not to exceed sum by $220,000, for an amended not to exceed sum of $1,320,000, and extend the Agreement term through March 31, 2025 (Attachment C).
WeatherTech®Raceway at Laguna Seca (WRLS) hosts many annual events that attract more than 325,000 local, national, and international visitors annually. During these events, restroom cleaning and sanitation services are essential to maintain facility cleanliness for public enjoyment.
Staff requests the Board of Supervisors approve and authorize the Monterey County Laguna Seca Representative to execute the proposed Amendment No. 2 to the Standard Agreement with Star Sanitation to increase the not to exceed sum by $220,000 for an amended not to exceed sum of $1,320,000 and extend the Agreement term through March 31, 2025 allowing for future amendments not exceeding 10% or $132,000 for a total aggregate sum of $1,452,000.
OTHER AGENCY INVOLVEMENT:
The Office of County Counsel and Auditor-Controller’s Office reviewed and approved the proposed Amendment No. 2 as to form and fiscal provisions, respectively.
FINANCING:
Costs associated with Amendment No. 2 will be incurred over 2 fiscal years, FY 2023-2024 and FY 2024-2025. The FY 2023-2024 Adopted Budget includes sufficient appropriations in Laguna Seca Recreation Area Fund 453, Budget Unit 8579, Appropriation Unit PFP067, to cover anticipated expenditures for the year. The FY 2024-2025 Recommended Budget will include sufficient appropriations to cover anticipated costs for that year.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
The recommended action supports the Board of Supervisors Strategic Initiatives for Infrastructure and Public Safety. The safety of event participants and the public is a priority at WRLS events, and these services are essential to maintain a clean and safe event environment.
