a. Approve Amendment No. 3 to the Agreement between the County and Moxxy Marketing for technical assistance, graphic design, web maintenance, Crop Report and outreach, to expand the scope of work and increase the amount payable by $50,000, for a total amount not to exceed $130,000;
b. Authorize the Agricultural Commission to execute Amendment No. 3; and
c. Authorize the Auditor-Controller to make payments in accordance with the terms of the Agreement and Amendment to the No.3 Agreement.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 3 to the Agreement between the County and Moxxy Marketing for technical assistance, graphic design, web maintenance, Crop Report and outreach, to expand the scope of work and increase the amount payable by $50,000, for a total amount not to exceed $130,000;
b. Authorize the Agricultural Commission to execute Amendment No. 3; and
c. Authorize the Auditor-Controller to make payments in accordance with the terms of the Agreement and Amendment to the No.3 Agreement.
SUMMARY/DISCUSSION:
Moxxy Marketing has been providing graphic design, web site design and maintenance, Crop Report development, and project management for the Agricultural Commissioner under the terms of a two-year Professional Services Agreement. The original agreement was executed on February 19, 2015. (See attached.) The Agreement has been amended twice previously to extend the term to June 30, 2017, expand the scope of services, and to increase the amount payable. (See attached.) Due to the addition of videography, public relations outreach and technical assistance, the Agricultural Commissioner’s Office requests this Amendment. Amendment No. 3 increases the amount payable from $80,000 to $130,000 and expands the scope to include the 2015 crop report. Amendment No. 3 is attached.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel has approved the proposed agreement as to form and legality.
FINANCING:
The proposed action utilizes available resources in the Agricultural Commissioner’s Budget for appropriate State reimbursable expenditures. There is no impact to the general fund.
