RECOMMENDATION:
It is recommended that the County of Monterey Board of Supervisors:
Approve and adopt a Resolution authorizing the Auditor-Controller to amend the Fiscal Year 2025-26 Adopted Budget for County Clerk/Recorder (027-1180-ACR003-8004) to increase appropriations by $228,771, financed by fund balance (027-3101) for Tyler Technologies, Inc.’s Eagle Clerk/Recorder Computer Software System (4/5ths vote required).
SUMMARY/DISCUSSION:
On June 24, 2025, the Board of Supervisors approved Amendment No. 2 to the agreement with Tyler Technologies, Inc. (A-15637) for the Advanced Records Processing software application to facilitate Phase II of the County Clerk/Recorder’s Restrictive Covenant Modification Program. However, the option to increase appropriations for a subsequent fiscal year was not available on June 25, 2025; County Clerk/Recorder now intends to modify its FY 2025-26 budget to finance the agreement.
Currently, the County Clerk/Recorder utilizes Tyler Technologies, Inc. for hosting of real property documents from 1978 to the Present for business purposes and customer viewing in the lobby. On September 28, 2021, the Governor approved Assembly Bill No. 1466 regarding real property discriminatory restrictions. Beginning July 1, 2022, as per Government Code Section 12956.3, the County Recorder’s office “shall establish a restrictive covenant program to assist in the redaction of unlawfully restrictive covenants in violation of subdivision (I) of Section 12955.”
The recommended action will increase appropriations in County Clerk/Recorder’s Modernization Fund to finance a previously approved vendor agreement using fund balance, with no impact on the general fund.
OTHER AGENCY INVOLVEMENT:
The Board of Supervisors approved Amendment No. 2 to the agreement with Tyler Technologies, Inc. on June 24, 2025 (Legistar File Number A 25-265). County Counsel has reviewed the Resolution and has approved it as to form only.
FINANCING:
The recommended action will increase appropriations in the County Clerk/Recorder’s FY 2025-26 Adopted Budget in the amount of $228,771, financed by the County Clerk/Recorder’s Modernization Fund (027-2730-ACR003-8004).
There is no additional financial impact to the County General Fund.
