RECOMMENDATION:
It is recommended that the Board of Supervisors:
Approve and Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to sign Amendment #9 to Agreement A-12200, retroactive to 09/30/2017, between the County of Monterey and California Forensic Medical Group, Inc. (CFMG) for provision of adult inmate medical services for the Monterey County Adult Detention Facility, extending the agreement retroactive from September 30, 2017 to December 31, 2017. The estimated total cost for the three month extension through December 31, 2017 is $2,140,000.
SUMMARY:
The Sheriff requests approval of this amendment to ensure continuation of service delivery while finalization of a new contract occurs.
DISCUSSION:
California Forensic Medical Group, Inc. (CFMG) has been the provider of inmate medical services at the Monterey County Adult Detention facility since July 1, 1989. This contract (A-12200) was awarded effective April 1, 2012 via a Request for Proposals (RFP) process. The annual cost of this contract for direct medical service provision within the Adult Detention facility in FY 2015-16 was $7,678,207 and FY 2016-17 was $8,134,328, which included $168,447 in HIV medicine costs exceeding the cap in the contract.
A new contract, compliant with the guidelines established by the Hernandez litigation and its subsequent oversight, is undergoing negotiation, and input was provided by the Board of Supervisors Budget Committee on 09/27/2017. The new proposed contract includes removal of the $15,000 cap per each inpatient episode, to meet Department of Health Care Services (DHCS) guidelines for participation in the Medi-Cal for Inmates Eligibility Program (MCIEP). These guidelines dictate that the Sheriff’s Office must pay all inpatient bills as primary guarantor to be partially reimbursed for Medi Cal inpatient claims.
A copy of Agreement A-12200 and all associated amendments is on file at the Clerk to the Board’s Office.
OTHER AGENCY INVOLVEMENT:
County Counsel has approved the agreement as to legal form, and the Auditor-Controller has reviewed for fiscal provisions.
FINANCING:
The amount of this CFMG contract amendment as presented will be $4,280,000.00 for the period of July 1, 2017 through December 31, 2017. The amendment is based on the current contract. The FY 2017-18 adopted budget includes $8,364,170, which is sufficient to cover this action. There is no increase in General Fund Contribution resulting from this board action. However, it is anticipated that once the new contract is finalized, the cost will be over the current budgeted amount, which will be addressed in a separate report.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
This contract meets the Board’s Health objectives by improving the health of at risk populations and transient persons incarcerated at the Adult Detention facility.
