Approve Amendment No. 1 to Agreement No. A-12434 with The Gordian Group, Inc. to include Job Order Contracting (JOC) Complete Solution Plus, construction estimating services, and project budgeting and planning on a project-by-project basis with no change to the current contract amount not to exceed $2,250,000 over a five year term, with a maximum amount of $450,000 per fiscal year, for the existing term through April 1, 2016, with the option to extend the Agreement for two (2) additional one (1) year periods; and
b. Authorize the Contracts/Purchasing Officer to execute Amendment No. 1 to Agreement No. A-12434, and up to three (3) future amendments that do not significantly alter the scope of work or change the approved Agreement amount.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve Amendment No. 1 to Agreement No. A-12434 with The Gordian Group, Inc. to include Job Order Contracting (JOC) Complete Solution Plus, construction estimating services, and project budgeting and planning on a project-by-project basis with no change to the current contract amount not to exceed $2,250,000 over a five year term, with a maximum amount of $450,000 per fiscal year, for the existing term through April 1, 2016, with the option to extend the Agreement for two (2) additional one (1) year periods; and
b. Authorize the Contracts/Purchasing Officer to execute Amendment No. 1 to Agreement No. A-12434, and up to three (3) future amendments that do not significantly alter the scope of work or change the approved Agreement amount.
SUMMARY/DISCUSSION:
California Public Contract Code Section 20128.5 provides that counties may award annual contracts for repair, remodeling or other repetitive work to be done according to unit prices. This is commonly referred to as Job Order Contracting (JOC), and is typically done by developing a construction task catalog that is then competitively bid. JOC improves economy and efficiency in completing many public works projects, including urgent and time sensitive projects.
On April 9, 2013, the Board of Supervisors approved Agreement No. A-12434 with The Gordian Group, Inc. to provide the County with a JOC system with an extensive catalog of construction tasks and associated technical specifications that contain over 260,000 individual items for an amount not to exceed $2,250,000 over a five year term, with a maximum amount of $450,000 per fiscal year, effective from the date of execution of the Agreement for a term through and including April 1, 2016, with the option to extend the Agreement for two (2) additional one (1) year periods. Under this agreement, The Gordian Group, Inc. receives 5% of the value of the work ordered. The JOC solution currently provided to the County by The Gordian Group, Inc. is referred to as the JOC Complete Solution®, which currently supports the County's JOC program, including assistance with developing each job order from identification to job order issuance. The amendment proposed is to increase the fee by 5.95% for a total fee of 10.95% to cover both the Complete Solution® and Complete Solution PlusTM services.
In addition to job order development services, the County has identified the need for The Gordian Group, Inc. to provide the JOC Complete Solution PlusTM option, that includes construction management services to manage job orders from job order issuance to completion of the punch list to job order close-out. This will allow the County to complete projects more quickly and more effectively and provide for greater field observations when needed on a project-by-project basis. Construction estimating services and project budgeting and planning can be provided as requested by the County to further assist in project delivery and can be provided if needed.
The fee for The Gordian Group, Inc. JOC Complete Solution PlusTM will be 5.95% of the value of the work ordered and will be payable when construction of a job order has been completed and accepted by the County. Construction estimating, project budgeting and planning services will be billed at $150 and $160 per hour respectively payable at the end of each calendar month. These fees are fair and reasonable prices within the construction management industry. The Gordian Group, Inc. is able to provide these services uniquely since they are already under contract for Job Order Contracting, are familiar with current projects and project schedules and are located in office space made available to them within the Monterey County Government Center campus.
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel and Auditor-Controller Office have reviewed and approved Amendment No. 1 as to form and legality, and fiscal provisions, respectively.
FINANCING:
Funds for these services are contained within the approved budget allocations of each individual department that may choose to utilize the JOC services. Expenditures will depend on the actual services requested by individual County departments.
