Title: a. RECOMMENDATION:
It is recommended that the Board of Supervisors:
a.      Approve and authorize Tom Shepherd, Deputy Chief Park Ranger/Operations Manager to sign on behalf of Monterey County one (1) Standard Grant Agreement and all necessary certifications and documents with the Department of Boating and Waterways for a new patrol boat (Agreement #12-204-755 for $80,000) in furtherance of receipt of the Grant;
 
b.      Authorize the Auditor-Controller's office to increase estimated revenues and appropriations totaling $80,000 in Appropriation Unit PAR004 (4/5 vote); and
 
c.      Authorize the Contracts/Purchasing Officer to approve purchase up to the approved grant amount $80,000 respectively.
 
SUMMARY/DISCUSSION:
The Department of Boating and Waterways (DBAW) administers the program to provide grant funding to local agencies for the purchase of boating enforcement equipment and patrol boats.  The Parks Department has regularly participated in this program in the past to the mutual benefit of the State and the County of Monterey.  The Parks Department filed two application requests to DBAW on March 28, 2012 regarding the current grant selection process.  In August of 2012, Parks' staff was advised that grant funds were available for this purpose. As a result, the Parks Department was notified that one grant was awarded:  $80,000 for the replacement of parks patrol boat 98L001 and trailer 98L001T for use at the South County Lake operations.
 
On September 11, 2012, your Board considered and approved an earlier version of this grant and Standard State Agreement; subsequently the DBAW informed County staff that the forms and Agreement had been modified at the State level and Monterey County would need to process the new updated version of the documents though your Board.  With even less time available due to the changes by the State, immediate action must be taken in order to take advantage of this grant opportunity.  
  
The grant must be fully executed and the entire transaction (ie, bid, purchase, reimbursement, certifications, etc.) completed no later than September 30, 2013.  A copy of the new Standard Agreement is on file with the Clerk of the Board.  
 
OTHER AGENCY INVOLVEMENT:
The Standard Agreement, Equipment and Operation Contract, Contractor Certification Clauses and Recycling Certification were reviewed and approved as to form by County Counsel and the Purchasing Manager.
 
FINANCING:
Lakes Enterprise Fund 452 will incur the cost out of Fiscal Year 2012-13 Approved Budget appropriations.  The cost of the equipment is 100% grant reimbursable and all expenditures and subsequent reimbursement activity is anticipated by the close of the fiscal year ending June 30, 2013.  Additionally, the Parks department expects to see some cost savings associated to the reduction in maintenance and repair as a result of the replacement of older County assets.
