RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
 
a. Approve Amendment No. 1 to Utility Agreement No. 3820.02 between County of Monterey and California American Water Company, A-12200, for reimbursement of additional piping components for the Schulte Road Bridge at Carmel River, County Bridge No. 501, State Bridge No. 44C-0115, in the amount of $39,337 including an additional 5% contingency, for a total of $209,947; and
 
b. Authorize the Director of Public Works to execute Amendment No. 1 to Utility Agreement No. 3820.02 with California American Water Company.
 
SUMMARY/DISCUSSION:
On March 27, 2012, the Board of Supervisors approved Utility Agreement No. 3820.02 with California American Water Company, A-12200, (Agreement) for the relocation of water lines into the proposed bridge conduits for the Schulte Road Bridge at Carmel River, County Bridge No. 501, State Bridge No. 44C-0115 (Project).  The Agreement reimburses the County for all costs in the relocation of the waterline.  It also requires California American Water Company (Cal-Am) to reimburse any additional costs that may result from contract change orders.  Cal-Am is required by franchise agreement to relocate the water utility lines from the existing bridge into the new bridge in conjunction with the Schulte Road Bridge Project at their expense.  Cal-Am requested that the relocation work be performed by R. M. Harris Company Inc. under their construction contract with the County of Monterey.
 
During construction, Cal Am requested additional work, resulting in Change Order No, 9 to procure and install piping components to improve the function of the pipeline.  Amendment No. 1 to Agreement requires Cal-Am to compensate the County of Monterey for the additional work.
 
The total value of the work to be done on the waterline relocations exceeded the 10% contingency amount originally estimated in the agreement.  The proposed Amendment No. 1 to the Agreement increases the amount to be reimbursed by Cal-Am and adds an additional 5% contingency.
 
OTHER AGENCY INVOLVEMENT:
The Resource Management Agency -Public Works (RMA-PW) worked closely with Cal-Am determine the most efficient and cost-effective required course of action for this project.  The Caltrans Local Assistance Office was also consulted in regards to the Federal funding.  The Office of the County Counsel has reviewed and approved Amendment No. 1 to Agreement as to form.
 
FINANCING:
There is no financial impact to the General Fund for the construction phase of the Project.  The Agreement No. 3820.02 estimated the waterline work was $155,100 plus 10% contingency ($15,510) for a total of $170,610, fully reimbursed by Cal Am to date.  Change Order No. 9, in the amount of $44,439.92, exceeds the 10% contingency on deposit, by $28,929.92.  Under Amendment 1 of the Agreement, Cal Am agrees to pay the County $39,337, of which $28,929.92 will be applied to Change Order No. 9 costs, leaving a remaining balance of $10,407.08 as an additional contingency.  The estimated costs for the work is $199,539.92 and the total amended Agreement is $209,947 for Cal Am's utility relocation work.  The attached revised Project Budget reflects updated costs.
