RECOMMENDATION:
It is recommended that the Board of Supervisors:
 
a. Receive a report on Monterey Bay Unified Air Pollution Control District enhanced vapor recovery upgrade requirements for Standing Loss Control Retrofits; and
b. Approve retrofitting nine aboveground gasoline storage tanks in order to conform to California Air Resources Board Executive Order VR-301 by April 1, 2013.
 
SUMMARY/DISCUSSION:
In 2008, the California Air Resources Board (CARB) adopted new enhanced vapor recovery (EVR) performance standards and specifications for aboveground gasoline storage tanks.  These new standards and specifications cover standing loss control Phase I deliveries into the tanks and Phase II deliveries into motor vehicles.  There are nine aboveground gasoline storage tanks identified in the County that are classified as "non-protected" tanks.  In order to conform by the compliance deadline of April 1, 2013 to CARB Executive Order VR-301, the following actions are required:  1) installation of Husky Model 5885 Pressure-Vacuum Vent Relief Valve, CARB Certified, serving the existing aboveground gasoline storage tanks; 2) application of CARB certified white paints to the existing aboveground gasoline storage tanks; and 3) completion of a static pressure performance test for the aboveground tanks and piping components.

FINANCING:
There were no funds identified in the FY 2012-13 Adopted Budget for the Resource Management Agency (RMA) to cover the costs associated with compliance to the enhanced vapor recovery upgrade requirements.  The FY 2012-13 recommended Budget identified the EVR as a policy consideration which stated staff would come back to the Board of Supervisors with a plan for implementation.  The estimated cost of retrofitting the County's nine 'none-protected' above ground gasoline storage tanks is approximately $40,000.  If the Board approves the recommendation to retrofit the nine aboveground gasoline tanks, RMA will work closely with its assigned CAO Budget and Analysis Analyst during the course of FY 2012-13 to determine if a budget modification will be required to increase appropriations for this effort.  Should it be determined that RMA's approved budget is unable to fully absorb currently unbudgeted costs related to the EVR retrofits, a request for budget modification to maintain fiscal balance will be presented through the Board's Budget Committee prior to year-end.  RMA will capture the expenditures specific to this activity in its Fleet Admin Unit 8185, Appropriation RMA007.
