RECOMMENDATION:
It is recommended that the Planning Commission conduct adopt a resolution (Exhibit B) to:
1) Find a previously adopted Negative Declaration adequately addressed potential environmental impacts and the proposed amendment does not require subsequent environmental review pursuant to CEQA Guidelines Section 15162(c);
2) Approve an amendment (PLN060581-AMD1 Premier Real Estate Inc.) to a previously approved Minor Subdivision for (PLN060581 Michelet/Goode) to modify Condition of Approval No. 8 of Resolution No. 060581 to implement Monterey County Inclusionary Housing requirements specified in Section 18.40.060.A of the Monterey County Code and identifying the project as an Owner Occupied Development; and
3) Adopt the attached Revised Condition Compliance and Mitigation Monitoring and Reporting Program, subject to 19 conditions.

SUMMARY:
The application, project plans, and related support materials submitted by the project applicant for the proposed development and public notice for the November 9th Planning Commission hearing identifies the proposed amendment as “PLN160158.” In order to properly track compliance with the previous Conditions of Approval contained within Resolution No. 060581 as well as the proposed modified Condition of Approval No. 8, the project file number referencing the amendment will be identified as “PLN060581-AMD1” within this Planning Commission staff report, proposed resolution, and Revised Condition Compliance and Mitigation Monitoring and Reporting Program.
On July 25, 2007, a Negative Declaration was adopted and a Minor Subdivision (PLN060581 Michelet/Goode) was approved, subject to 19 Conditions of Approval (Resolution No. 060581) by the RMA-Director of Planning. Subsequent to approval of the Minor Subdivision, the subject property was sold. During the condition compliance phase if the project, the property owner discussed the requirement of payment of the in-lieu fees for inclusionary housing with the Economic Development Department, Housing Division. Based on need of the new owner, one of the units to be constructed on one of the newly created lots will be occupied as his primary residence. Therefore, pursuant to the advice of Economic Development, the applicant has applied for an amendment to modify Condition of Approval No. 8, requesting the development be considered as an “Owner occupied development” as defined in the Monterey County Inclusionary Housing Ordinance. This would result in omitting the requirement of paying an Inclusionary Housing in-lieu fee of $40,687.80 and substitute it with a legally binding agreement pursuant to the requirement of Section 18.40 of the Monterey County Code. The proposed amendment was reviewed by Housing Division of Economic Development and has found to be consistent with the County’s Inclusionary Housing Ordinance #04185 as codified in Section 18.40 of the Monterey County Code (MCC).
The proposed amendment was not sent to the Housing Advisory Committee based on the determination of the Economic Development Department.
