RECOMMENDATION:

It is recommended that the Board of Supervisors:

Adopt Resolution No.     to:

a. Request the State of California Department of Motor Vehicles (DMV) increase the

one dollar ($1) vehicle registration fee authorized pursuant to section 9250.19 (2)(A) of the Vehicle Code to two dollars ($2); and

b. Request the DMV to increase from two dollars ($2) to four dollars ($4) the registration fee for commercial vehicles pursuant to section 9250.19(4)(A); and

c. Commence collection of the two dollar ($2) fee or four dollars ($4) for commercial vehicles on vehicle registrations within the County of Monterey, effective January 1, 2022.

 

SUMMARY/DISCUSSION:

California Penal Code Section 11112.1 defines key terms involving the Department of Justice and its network to exchange law enforcement data.

 

(a) “California Identification System” or “Cal-ID” means the automated system maintained by the Department of Justice for retaining fingerprint files and identifying latent fingerprints.

 

(b) “Remote Access Network” or “RAN” means a uniform statewide network of equipment and procedures allowing local law enforcement agencies direct access to the California Identification System.

 

(c) “Cal-ID Telecommunications System” means a statewide telecommunications network dedicated to the transmission of fingerprint identification data in conjunction with Cal-ID for use by law enforcement agencies.

 

California Penal Code Section 11112.4 establishes the Remote Access Network (RAN). The RAN Board is responsible to determine the placement of RAN equipment within the county and coordinate the acceptance, delivery, and installation of RAN equipment.  Considering the new and ongoing costs to support the RAN program in Monterey County, the RAN Board determined it was necessary to seek additional funding allowed by state law.  The RAN Board is comprised of:  A Board of Supervisor, The Sheriff, The District Attorney, two Police Chiefs, A Mayor, and an at-large member.  This proposal is being carried by the Sheriff’s Office on behalf of the RAN Board.

 

Existing law had authorized Monterey County to receive $1 service fee per vehicle licensed in the county and a $2 service fee on all commercial vehicles.  These funds are earmarked for use by law enforcement to provide automated mobile and fixed location identification services.  The costs for these services are approved by the Local Remote Access Network Board (RAN Board).

 

Effective January 1, 2015, AB 2393 amends the Vehicle Section 9250.19 to authorize an increase of $1 per vehicle licensed in the county to $2, and an additional $2 per commercial vehicles increasing the fee to $4.

 

Upon approval of this resolution, the Controller of the State of California will be notified, thereby authorizing the disbursement of monies owed to the county based on Monterey County’s concurrence with the amended Vehicle Code and authorization by resolution by its Board of Supervisors.

 

This proposal would assist all law enforcement agencies in the County of Monterey with on-going future costs of the Cal-ID and aid in funding future costs of this mandatory service.

 

Thus, we are requesting that the Board of Supervisors adopt the attached resolution allowing the State of California Department of Motor Vehicles to increase the one dollar ($1) vehicle registration fee authorized pursuant to section 9250.19 (2)(A) of the Vehicle Code to two dollars ($2), and from two dollars ($2) to four dollars ($4) for commercial vehicles pursuant to section 9250.19 (4)(A), and commence collection of the two dollar ($2) fee or four dollars ($4) for commercial vehicles on vehicle registrations within the County of Monterey, effective January 1, 2022. 

 

OTHER AGENCY INVOLVEMENT:

The CAO’s Office and County Counsel have reviewed this report and this request was presented to and supported by the Budget Committee on June 30, 2021.

 

FINANCING:

Additional funds collected pursuant to Vehicle Code Section 9250.19, estimated annually at $400,000, will be allocated to the RAN Board Budget for supporting the CAL-ID system and remote devices distributed throughout Monterey County.  All monies collected from this fee shall only be used for the costs, operation and maintenance of the county-wide CAL-ID Automated Fingerprint Identification System in accordance with the provisions of Penal Code Section 11112.1 et. seq.  This item will not result to an additional need for County General Fund Contribution.
