RECOMMENDATION:

It is recommended that the Board of Supervisors:

a.  Approve Amendment No. 1 to the Standard Agreement, Multi-Year Agreement #3200*6210, with Specialized Utility Services Program, Inc. to continue to provide Chief Plant Operator services for the water and wastewater utility systems at Lake San Antonio and County Service Area 75 - Chualar, and to: include services for Lake Nacimiento; update the annual cost of each location effective January 1, 2023;- increase the not-to-exceed amount by $67,624 for a total amount not-to-exceed $130,904; and extend the expiration date for one (1) additional year through December 31, 2023, for a revised term from January 1, 2022 to December 31, 2023; and

b.  Authorize the Contracts/Purchasing Officer or Contracts/Purchasing Supervisor to execute Amendment No. 1 to the Standard Agreement and future amendments to the Agreement where the amendments do not significantly alter the scope of work or increase the approved Agreement amount.

 

SUMMARY/DISCUSSION:

On January 18, 2022, the Contracts/Purchasing Officer executed a Standard Agreement (SA) with  Specialized Utility Services Program, Inc. (SUSP) in the amount of $63,280 to provide Chief Plant Operator (CPO) services for the water and wastewater utility systems at Lake San Antonio and County Service Area (CSA) 75 - Chualar for a term of January 1, 2022 through December 31, 2022.

 

The Department of Public Works, Facilities and Parks (PWFP) has an exigent need to have a licensed CPO provide certified oversight for the water and wastewater systems at Lake San Antonio, Lake Nacimiento, and CSA 75 - Chualar.  SUSP’s continued specialized services are needed to provide required oversight and training to PWFP staff not only at Lake San Antonio and CSA 75 - Chualar but at Lake Nacimiento, until such time that PWFP staff obtains required State certifications.  The services are required to comply with State permit requirements as required by the State Water Resources Control Board (SWRCB) for oversight, inspection and reporting associated with operation of water treatment and distribution and wastewater collection and treatment system that the County operates at these facilities.  Per State requirements, the County must have staff with State certifications appropriate for the types of water and wastewater systems operated by the County.  County staff does not have the required certifications.  SWRCB staff have verbally indicated to PWFP staff that failure to provide the certified services will result in violation of State permit requirements and a Notice of Violation which is subject to County financial penalties.

 

PWPF requests the Board of Supervisors approve Amendment No. 1 to the SA with SUSP (Attachment A) and authorize Contracts/Purchasing to execute the amendment.  The proposed Amendment No. 1 will allow for continued CPO services for the water and wastewater utility systems at Lake San Antonio and CSA 75 - Chualar, and further include services for Lake Nacimiento; update the annual cost of each location effective January 1, 2023; increase the not to exceed amount of $63,280 by $67,624 for a total amount not to exceed $130,904; and extend the expiration date for one (1) additional year through December 31, 2023, for a revised term from January 1, 2022 to December 31, 2023.

 

Attachment B provides the SA for reference.  Attachment C provides a summary of annual expenditures and current balance remaining for this SA.

 

OTHER AGENCY INVOLVEMENT:

The Office of the County Counsel and the Auditor-Controller’s Office have reviewed and approved Amendment No. 1 to the SA as to form, and fiscal provisions, respectively. 

 

FINANCING:

Sufficient appropriations are available in the PWFP Fiscal Year (FY) 2022-23 Adopted Budget for Nacimiento Resort/Recreation (Fund 452, Department 3200, Unit 8565, Appropriations Unit PFP060), Parks Operations (Fund 001, Department 3200, Unit 8556, Appropriations Unit PFP058), and CSA 75 - Chualar Consolidated (Fund 093, Department 3200, Unit 8566, Appropriations Unit PFP046) to finance Amendment No. 1 to the SA and will be included in the Recommended Budget for FY 2023-24. 

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The recommended action supports the Board of Supervisors’ Health and Human Services and Public Safety Strategic Initiatives by allowing continued operations and management services of these County systems, essential to ensure safe and reliable water supply to the public at these facilities, and compliance with the SWRCB.
