Approve and Authorize the Director of the Emergency Communications Department to sign no cost Volume Licensing Agreement V4697871 with Microsoft Corporation, Inc. for Software Assurance, effective when accepted by Microsoft Corporation, Inc. and continuing for a term of 36 months where payments for this product are made to 3rd party reseller eGroup Enabling Technologies, Inc. through a previously approved agreement; and
b. Authorize the Director of the Emergency Communications Department to sign up to three amendments to this agreement where the amendments do not add any financial obligations, do not significantly change the scope of the provided services, and do not result in a total agreement term of greater than six years.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and Authorize the Director of the Emergency Communications Department to sign no cost Volume Licensing Agreement V4697871 with Microsoft Corporation, Inc. for Software Assurance, effective when accepted by Microsoft Corporation, Inc. and continuing for a term of 36 months where payments for this product are made to 3rd party reseller eGroup Enabling Technologies, Inc. through a previously approved agreement; and
b. Authorize the Director of the Emergency Communications Department to sign up to three amendments to this agreement where the amendments do not add any financial obligations, do not significantly change the scope of the provided services, and do not result in a total agreement term of greater than six years.
SUMMARY/DISCUSSION:
The Monterey County Emergency Communications Department (ECD) is a consolidated public safety answer point and dispatch facility serving 28 law enforcement, fire protection, and emergency medical services (EMS) response agencies throughout Monterey County. Calls for service are dispatched through the ECD’s Computer Aided Dispatch (CAD) system.
On May 21, 2024, Agenda Item Number 37, this Board approved the ECD to enter into an agreement with eGroup Enabling Technologies, LLC. (eGroup) to purchase hardware, software, and professional services to rehost the Department’s CAD System to new servers. At the time of that approval, the ECD was not aware that this additional Volume Licensing Agreement (VLA) with Microsoft Corporation, Inc. (Microsoft) needed to be signed as well.
This VLA with Microsoft provides for Software Assurance. Software Assurance is an offering from Microsoft that provides new version rights and other benefits for products. This VLA ensures that the Microsoft software will be up to date for the term of this agreement with no unexpected upgrade costs.
The costs for this Software Assurance are paid to eGroup through the agreement that was previously approved by this Board so no additional funding is required. All required funding for this Microsoft Agreement is included in the previously approved eGroup agreement. eGroup is the 3rd party reseller of the Microsoft Software Assurance.
OTHER AGENCY INVOLVEMENT:
County Counsel has approved this Agreement as to legal form. Contracts/Purchasing has reviewed and approved this Agreement.
FINANCING:
No additional funding is required for this no-cost agreement.
BOARD OF SUPERVISORS STRATEGIC INITIATIVES:
This agreement correlates to the Board’s Public Safety Strategic Initiative by allowing the Department of Emergency Communications to maintain the Computer Aided Dispatch system for public safety dispatching.
