RECOMMENDATION:
a. Approve and authorize the Chair to execute an Agreement with the City of Salinas to rehabilitate Harris Road with hot mix asphalt in the City of Salinas;
b. Award a contract to Granite Construction Company, the lowest responsible bidder, for the construction of Harris Road Overlay, Project No. 13-142365, in the amount of $2,009,339;
c. Approve the Performance and Payment Bonds executed and provided by Granite Construction Company and Federal Insurance Company;
d. Authorize a contingency (not to exceed 10% of the contract amount) to provide funding for approved contract change orders;
e. Authorize the Director of Public Works to execute the contract and, subject to the terms of the Public Contract Code, approve change orders to the contract that do not exceed 10% of the original contract amount, and do not significantly change the scope of work;

SUMMARY/DISCUSSION:
On March 19, 2013, the Board of Supervisors adopted the Plans and Special Provisions for the Harris Road Overlay, Project No. 13-142365.  The Project was advertised and the bids were opened on April 12, 2013.  The lowest responsible bidder was Granite Construction Co. in the amount of $2,009,339.  The Engineer's Estimate for the bid was $2,427,027.  Project construction is scheduled to begin June 2013, with completion anticipated by October 2013.
 
The Project consists of hot mix asphalt concrete overlay including but not limited to pavement delineation, clearing and grubbing, reconstruction of failed pavement areas and traffic control.  The Project includes overlaying a portion of Harris Road within the City of Salinas city limits.  Project limits are from Railroad Avenue to Abbott Street, approximately 2.78 miles.
 
The County of Monterey proposes to make these pavement improvements on Harris Road.  Under the terms of the proposed Agreement between the City of Salinas and the County of Monterey, the City of Salinas shall contribute $400,000 to the cost of the Project for improvement of the segment of Harris Road within the Salinas city limits.  The City of Salinas currently maintains the segment of Harris Road from Abbott Street to approximately 1,260 feet south of Harris Place (approximately 0.42 mile).  Future maintenance of that segment of Harris Road will continue to be the responsibility of the City.
 
Once the contract is complete in all respects in accordance with the Plans and Special Provisions, the Director of Public Works will accept the Certification of Completion for the construction of the Project; and execute and record the Notice of Completion with the County Recorder's office.
 
This Project meets the criteria for Categorical Exemption to California Environmental Quality Act (CEQA) under CEQA Guidelines, Section 15301.  A Notice of Exemption was filed with the County Recorder's Office on September 26, 2012.
 
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel, and Contracts/Purchasing, attended the bid opening and reviewed the low bid for conformance with applicable regulations.  The Office of the County Counsel, Auditor-Controller, and Risk Management have reviewed and approved the contract documents as to form, fiscal terms, and insurance provisions, respectively.
 
FINANCING:
There is no financial impact to the General Fund.  Total estimated Project cost, engineering, construction management and construction, is $3,000,000.  The Project is funded by the Road Fund (Fund 002, Unit 8195) in the amount of $600,000, Fund 404 in the amount of $2,000,000, and the City of Salinas in the amount of $400,000.  There are sufficient appropriations in the FY 2012-13 Road Fund to finance this Project for the work anticipated in FY 2012-13.  The remainder of the project costs have been planned for in the FY 2013-14 recommended Budget.
