Recommend that the Monterey County Water Resources Agency Board of Supervisors, upon approval as to form by County Counsel:
a. Approve a Drainage and Flood Control Systems Agreement for each subdivision phase of the Pebble Beach Company project including Areas J, K, and L; and
b. Authorize the Chair to execute a Drainage and Flood Control Systems Agreement for each subdivision phase of the Pebble Beach Company project including Areas J, K, and L, by and among, the Monterey County Water Resources Agency, and the Pebble Beach Company.

RECOMMENDATION:
It is recommended that the Monterey County Water Resources Agency Board of Directors recommend that the Monterey County Water Resources Agency Board of Supervisors, upon approval as to form by County Counsel:
a. Approve a Drainage and Flood Control Systems Agreement for each subdivision phase of the Pebble Beach Company project including Areas J, K, and L; and
b. Authorize the Chair to execute a Drainage and Flood Control Systems Agreement for each subdivision phase of the Pebble Beach Company project including Areas J, K, and L, by and among, the Monterey County Water Resources Agency, and the Pebble Beach Company.
SUMMARY/DISCUSSION:
On June 19, 2012, the Monterey County Board of Supervisors approved the Pebble Beach Company (PBC) project “PLN 100138” which allows 12 subdivision phases resulting in 90 to 100 residential lots amongst 866 acres. The PBC is requesting final map approval for three phases of this project including: Area J - “Spyglass 3”; Area K - “Spyglass 2”; and, Area L - “Spyglass 1”. As part of the final map requirements, a Drainage and Flood Control Systems Agreement must be recorded for each subdivision phase. This type of agreement is standard for subdivision projects in unincorporated Monterey County. Such an agreement is executed to ensure property owners and/or associations properly maintain and continue to provide storm-drain infrastructure to control any flood and storm waters associated with the project. It is through this Drainage and Flood Control Systems Agreement that the PBC agrees to “properly maintain, repair, improve, and operate the drainage and flood control systems” located within subdivision areas J, K, and L.
The agreement requires the PBC to submit an annual maintenance report, prepared by an engineer, to the Monterey County Water Resources Agency (MCRWA) by August 15th of each year. If the report identifies, or if other conditions arise, that maintenance, repairs, or improvements are required, the PBC is required to take these types of corrective actions. If corrective actions are not taken, the MCWRA per these agreements could collect fees and recover costs to restore the storm-drain improvements if necessary.
OTHER AGENCY INVOLVEMENT:
The RMA-Planning Department is scheduling the final maps for Areas J, K, and L to go before the Monterey County Board of Supervisors on March 13, 2018. At that time, the Drainage and Flood Control Systems Agreements would also be scheduled before the Monterey County Water Resources Agency Board of Supervisors. If approved and executed by the Chair of the Monterey County Water Resources Agency Board of Supervisors, the agreements would then be forwarded to the RMA-Planning Department to be recorded concurrently with the final maps.
