RECOMMENDATIONS:
It is recommended that the Board of Supervisors:
a. Approve the Road Maintenance Agreement with Vance Querfurth, an individual ("Querfurth"), in compliance with Condition of Approval No. 30 of Development Permit No. PLN090191, located six miles west of Highway 101 and San Ardo, northerly of Lockwood - San Ardo Road, South County; and
b. Authorize the Chair of the Board to execute the Road Maintenance Agreement.
 
SUMMARY/DISCUSSION:
On October 26, 2011, the Monterey County Planning Commission approved a Use Permit (PLN090191) and Reclamation Plan for a surface mining operation on approximately twelve acres on Federal land (Bureau of Land Management) located six miles west of Highway 101 and San Ardo, northerly of Lockwood - San Ardo Road.  To address impacts to the transportation system, the Conditions of Approval and Mitigations for this project included payment of a Traffic Mitigation Fee and a Road Maintenance Agreement (Conditions No. 29 and 30).  Mitigation No. MM15-2 requires the applicant to enter into a Road Maintenance Agreement to provide for maintenance necessary improvements for the entire hauling route.
 
A Road Surface Evaluation prepared by Pacific Waste Services, Inc., identified as necessary improvements widening of the road, installation of signage, additional grading of the hauling route, and maintenance (vegetation trimming).
 
OTHER AGENCY INVOLVEMENT:
The Office of the County Counsel, and Risk Management, have reviewed and approved the Road Maintenance Agreement as to form, and insurance provisions, respectively.
 
FINANCING:
There is no financial impact to the General Fund.  All associated costs are funded by the Road Maintenance Agreement.
