a. Approve and authorize the Contracts/Purchasing Officer to sign three (3) Memoranda of Understanding in the amounts of $189,948, $138,096, and $160,915 with the Monterey County Office of Education for collaborative services with the Boronda Community School, the Silver Star Resource Center, Independent Study Program, and the Salinas/Warner Davis Community Schools during FY 2012-2013; and
b. Authorize the Contracts/Purchasing Officer to sign up to three (3) future amendments to each Agreement where the amendments do not exceed ten percent (10%) of the original contract amount and do not significantly change the scope of work.

RECOMMENDATION:
It is recommended that the Board of Supervisors:
a. Approve and authorize the Contracts/Purchasing Officer to sign three (3) Memoranda of Understanding in the amounts of $189,948, $138,096, and $160,915 with the Monterey County Office of Education for collaborative services with the Boronda Community School, the Silver Star Resource Center, Independent Study Program, and the Salinas/Warner Davis Community Schools during FY 2012-2013; and
b. Authorize the Contracts/Purchasing Officer to sign up to three (3) future amendments to each Agreement where the amendments do not exceed ten percent (10%) of the original contract amount and do not significantly change the scope of work.
SUMMARY:
The Monterey County Office of Education (MCOE), through its Alternative Education Programs, operates community day schools including the Boronda Community School, the Silver Star Resource Center, Independent Study Program, and the Salinas/Warner Davis Community Schools. These schools serve at-risk youths who have been expelled from school districts. MCOE has requested Probation to assist in truancy issues at these sites.
DISCUSSION:
Probation provides services to ensure the orderly and effective operation of the community schools, and enhance the level of assistance available to the students in attendance. Probation allocates one Probation Officer and one Probation Aide to oversee the Boronda Community School, one Probation Officer to oversee the Silver Star Resource Center Independent Study Program, and one Probation Officer and one Probation Aide to oversee the Salinas/Warner Davis Community Schools. The Probation Officer manages cases and enforces conditions of probation while the Probation Aide provides oversight and support services to the students in the community schools during school hours.
OTHER AGENCY INVOLVEMENT:
The MOU has been approved by County Counsel as to legal form and by the Auditor-Controller as to fiscal terms.
FINANCING:
MCOE will reimburse the Probation Department for a total of $488,959 for the staffing and operating costs of the programs, and specifically $189,948 for Boronda Community School, $138,096 for the Silver Star Resource Center Independent Study Program and $160,915 for the Salinas/Warner Davis Community Schools. Funding for the existing positions is already contained in the approved budget for Department 2550, Unit 8162 for Fiscal Year 2012-13.
There is no cost to the County General Fund with the recommended action.
