RECOMMENDATION:
It is recommended that the County of Monterey Board of Supervisors:
a. Approve and authorize the Director of Health Services or designee to execute a Local Interagency Agreement with Monterey County Special Education Local Plan Area (SELPA) to facilitate the provision of occupational and physical therapy services for the term upon execution to June 30, 2030 at no cost to the County of Monterey; and
b. Approve a non-standard Agreement as recommended by the Director of Health Services; and
c. Approve and authorize the Director of Health Services or designee to sign up to three future amendments that do not significantly change the scope.
SUMMARY/DISCUSSION:
The Medical Therapy Program (MTP) is a statewide sub-program of the CCS program which offers medically necessary occupational therapy and physical therapy services to children and young adults with qualifying physically disabling conditions. MTP is administered in coordination with county public health offices and local education entities, often SELPAs.
The Health Department’s MTP requests this local interagency Agreement to facilitate the provision of medically and educationally necessary occupational and physical therapy services, as required under Title 2 of the California Code of Regulations (CCR) section 60310 and Title 34 of the Code of Federal Regulations (CFR) section 300.154. Specifically, the Agreement outlines the general responsibilities for Monterey County SELPA and the Health Department’s MTP. The California Department of Health Care Services provides suggested language for the agreement to ensure the Agreement is aligned with state regulations. The MTP works with the County of Monterey SELPA to deliver occupational and physical therapy services in school settings to children with qualifying physically disabling conditions and their families.
This work supports the County of Monterey Health Department 2025-2028 Strategic Plan Goals: 1. Build community power and partners’ capacity to increase equity and improve health; 2. Provide exceptional person-centered care through accessible, community-focused health services. It also supports four of the ten essential public health services, specifically: 2. Investigate, diagnose, and address health problems and hazards affecting the population; 3. Communicate effectively to inform and educate people about health, factors that influence it, and how to improve it; 4. Strengthen, support, and mobilize communities and partnerships to improve health; and 7. Assure an effective system that enables equitable access to the individual services and care needed to be healthy.
OTHER AGENCY INVOLVEMENT:
The Offices of County Counsel, Risk Management, and Auditor-Controller have reviewed and approved this Agreement as to legal form and fiscal provisions, respectively.
FINANCING:
There is no impact to the General Fund from approval of this agreement.
