Title: a. RECOMMENDATION:

It is recommended that the Board of Supervisors:

a. Approve and authorize the Director of the Information Technology Department to execute a non-standard agreement with Environmental Systems Research Institute, Inc., (ESRI Inc.,) for purchase of the Enterprise Advantage Program, including consulting, training and technical services, for upgrade of the County’s GIS system in an amount not to exceed $200,000.00, for a term retroactive to October 1, 2018 to September 30, 2021; and

b. Accept non-standard language as recommended by the Director of the Information Technology Department; and

c. SUMMARY:

It is requested that the Board of Supervisors authorize the Director of Information Technology to sign a non-standard Agreement with ESRI Incorporated to provide Enterprise Advantage Program (EAP) consulting, training and technical services for the County’s GIS system.

 

DISCUSSION:

The Information Technology Department currently maintains a Master Agreement with ESRI Incorporated to support the needs of County Departments that use GIS products for County servers, and County access to GIS online data. These licenses allow County Departments to access location intelligence to manage their resources in serving the public.

 

To support the Information Technology Department (ITD) roadmap for GIS, it is recommended that the County purchase ESRI’s Enterprise Advantage Program (EAP).  ESRI EAP will provide the consulting, training and technical services to assist ITD to -

 

                     Establish the ArcGIS Portal to support the County's push towards a mobile work force with location intelligence.

                     Upgrade to ArcGIS Pro which enables multi-threading capabilities, better and faster renderings of 3D data, increased analytical capabilities, and improved integration with web-based technology.

                     Upgrade the County’s Geodatabase to ensure data compatibility with modern applications.

                     Establish a Failover environment to ensure continuous operations in case of hardware failures.

 

The proposed agreement, using ESRI Inc.’s contract language, contains provisions that are not standard to the County, but are standard in the software support industry. 

The Director of Information Technology Department and technical County staff believe the non-standard Agreement with ESRI Inc., poses minimal risk to the County and acceptance of these terms by the Board is recommended.

 

OTHER AGENCY INVOLVEMENT:

County Counsel has reviewed the ESRI agreement and cannot approve due to the following nonstandard terms:  nonstandard indemnification provisions; non-standard insurance provisions, non-solicitation of employee provisions; binding arbitration of disputes; non-standard termination provisions, limitations on vendor liability to either correction of breach or refund of agreement payments; force majeure provisions, and disclaimer of warranty.

 

FINANCING:

The funds for payment of the costs of the Information Technology Department’s use of this Agreement have been included in the Fiscal Year 2018-2019 Approved Budget for the Information Technology, ITD 1930, Unit 8433, Appropriations Unit INF 002.

 

BOARD OF SUPERVISORS STRATEGIC INITIATIVES:

The services provided pursuant to this agreement will support mobile GIS system for the County.
