RECOMMENDATION:

It is recommended that the Board of Supervisors:

Approve and Authorize the Sheriff or her designee to execute Amendment #1 to the Non-Standard Agreement with Miller Mendel, Inc. for electronic Statement of Personal History background investigation system, for a term beginning September 5, 2025 through September 4, 2026 which shall auto-renew for one (1) year terms thereafter until terminated, adding $2,963 for a revised agreement amount of $14,994 and increase annually by no more than $3,500.

 

SUMMARY/DISCUSSION:

The Board of Supervisors originally approved the Non-standard agreement on August 27, 2024; at that time the clause for the automatic renewal was mistakenly left off the Board Report.  The Monterey County Sheriff’s Office (“MCSO”) is required to perform background clearances on all its personnel. Peace officer candidates have minimum selection standards as detailed in Government Code Sections 1029-1031.2. Additional restrictions are placed on peace officers by Penal Code 29805. The MCSO must perform a background check on all non-sworn employees (professional and jail support staffs) which adds significant time delays to filling positions (currently, this process is contracted out).

The MCSO has implemented the electronic Statement of Personal History (eSOPH) background investigation system. eSOPH is a browser based, case management software application designed to electronically conduct all steps of the background investigation process, from the acceptance of background information from the applicant to the hiring of the applicant. eSOPH is expandable and customizable. The background check requires the review of personal history statements, past employment, driving records, credit history, military service, and previous tenancy history and a polygraph.

The following law enforcement agencies use Miller Mendel eSOPH background investigation system: Riverside County Sheriff, Santa Clara County Sheriff, San Jose Police Department (“PD”), Stockton PD, Elk Grove PD, and San Luis Obispo PD.

 

OTHER AGENCY INVOLVEMENT:

The Office of County Counsel has reviewed and approved as to legal form.   The Office of Risk Management notes the following non-standard provisions and is not authorized to approve based upon the following:  no representations or warranties, mutual indemnification, limited liability provisions, and automatic renewal (ever-green) provision.  The Auditor-Controller has reviewed the agreement but does not agree to the non-standard payment provisions.

 

FINANCING:

The cost of this contract is included in the FY 2025-26 Recommended budget. There will be no increase in General Fund Contribution in the current fiscal year resulting from this Board action.
